SUBJECT: CUP 217(A)X2 -TYLER COURT SENIOR APARTMENTS -Request for an
extension of CUP 217(A) to allow the continued operation of a 75 unit senior
residential apartment project located at 3363 Tyler Street in Local Facilities
Management Zone 1.
I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolution No. 4829
APPROVING an extension of CUP 217(A)x2 based upon the findings and subject to the
conditions contained therein.
II. INTRODUCTION
This proposed extension of CUP 217(A)xl will allow the continued operation of a 75 unit senior
residential apartment project currently owned by the Carlsbad Housing and Redevelopment
Agency. Since the Housing and Redevelopment Agency purchased the property, the project has
become an affordable housing project with rental rates restricted to those affordable to extremely
low and very low income households. Otherwise, the project continues to operate in
conformance with the required conditions. The CUP would be retroactively extended from
March 4, 1997.
III. PROJECT DESCRIPTION AND BACKGROUND
On March 4, 1992, the Planning Commission approved a five year extension of CUP 217(A)xl
to allow a 75 unit senior apartment project at 3363 Tyler Street in the RDM Zone to continue to
operate through March 4, 1997. The Tyler Court Senior Apartments were approved by
Conditional Use Permit in accordance with the Senior Housing Ordinance in affect in 1984.
Although CUP 217(A)xl expired in 1997, the applicant, the City of Carlsbad Housing and
Redevelopment Agency, is requesting a retroactive extension of CUP 217(A)xl from March 4,
1997 to the present and to extend the conditional use for an unlimited time period. Condition
No. 2 of the approving CUP Resolution No. 3297 specifies that CUP 217(A)xl may be extended
for a period of time not to exceed five years upon written application of the permittee.
On September 30, 1999, the City of Carlsbad Housing and Redevelopment Agency (Agency)
purchased Tyler Court and placed affordability requirements on the property to ensure that it
would remain an affordable senior housing complex for Carlsbad's senior community. Fifty
percent of the units are currently rented to extremely low income senior households (households
earning 30% or less of the area median income) and the remaining units are rented to very low
income households (households earning 50% or less of the area median income). The Agency

has retained the Interfaith Housing Assistance Corporation (IHAC) to manage the Tyler Court
Apartments. The proposed extension can be justified based on the extensive monitoring that will
be conducted by IHAC which includes ensuring that each tenant meets the age requirements
established by CUP 217(A)xl along with the income requirements established by the Housing
and Redevelopment Commission. IHAC provides the Housing and Redevelopment Agency with
a quarterly report stating the age and income of all tenants. In addition, because federal home
funds were used to acquire the property, the Housing and Redevelopment Agency is required to
provide a similar annual report showing that the residents meet the low-income requirements of
the home program.
IV. ANALYSIS
A. The senior apartment project continues to be consistent with all applicable plans, policies
and regulations described below:
1. Carlsbad General Plan
2. Local Facilities Management Plan 1
3. Title 21 of the Carlsbad Municipal Code
B. The adopted project findings for CUP 217(A)xl, which are contained m Planning
Commission Resolution No. 3297 still apply to this project.
C. The adopted project conditions for CUP 217(A)xl, which are contained in Planning
Commission Resolution No. 3297 still apply to this project with the exception of
Condition No. 2 which is amended by Condition No. 4 in Planning Commission
Resolution No. 4829 to extend CUP 217(A)x2.
D. No formal written complaints regarding Tyler Court Apartments have been submitted to
the City.
E. Annual reviews have been conducted by the Planning Department and Housing and
Redevelopment Agency, and the project is in compliance with all conditions of approval.
V. ENVIRONMENT AL REVIEW
The Planning Director has determined that this project is exempt from the requirements of the
California Environmental Quality Act (CEQA) per Section 15301, Existing Facilities, of the
State CEQA Guidelines and will not have any adverse significant impact on the environment.
