SUBJECT: CUP 224(A)xl -J. C. DEU -A request for an extension of Conditional Use
Permit No. 224(A) to allow the operation of a deli at 2382-A Camino Vida
Roble, in Local Facilities Management Zone 5.
I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolution No. 3388
APPROVING CUP 224(A)xl based on the findings and subject to the conditions contained
therein.
II. PROJECT DESCRIPTION AND BACKGROUND
This application is for an extension of Conditional Use Permit 224(A) for a delicatessen in
the P-M zone. The delicatessen was originally approved in January, 1983, and has been
operating without incident since opening. The deli operates as a "take-out only" service
with no customer seating provided as specified in the original conditions of approval.
Conditions of approval for some of the City's deli's have been amended to allow seating.
However, this deli is too small to accommodate tables and chairs. The shop serves cold
sandwiches only. There is no on-premise cooking except for a microwave oven. The
operating hours of the deli are 7:00 a.m. to 6:00 p.m., also in compliance with the
approving conditions.
III. ANALYSIS
1. Can the four findings required for a Conditional Use Permit still be made? Namely,
a) That the deli is necessary or desirable for the development of the community,
is essentially in harmony with the various elements and objectives of the
general Plan, and is not detrimental to existing uses or to uses specifically
permitted in the zone in which it is located;
b) That the site for the deli is adequate in size and shape to accommodate the
use;
c) That all of the yards, setbacks, walls, fences, landscaping, and other features
necessary to adjust each deli to existing or permitted future uses in the
neighborhood is provided and maintained;

d) That the street system serving the deli is adequate to properly handle all
traffic generated.
DISCUSSION
1. Desirability and Harmony of Use
The delicatessens in the industrial area serve a large lunchtime clientele, and provide a
needed service to an area void of alternative eating establishments. This is consistent with
one of the goals of the Land Use Element of the General Plan, which is to "generate the
development of commercial enterprises that support local industries ... ". The Circulation
Element requires that commercial developments provide adequate parking. This deli
provides two parking spaces as required. By providing food service to the employees of the
industrial area and providing the required parking, the delicatessen remains consistent with
the General Plan and is not detrimental to existing or future uses.
2. Adequacy of Site in Size and Shape
The area of the deli (approximately 500 square feet) continues to be adequate in size and
shape to accommodate the use. All of the activities of the deli occur within the building.
No indoor or outdoor seating is provided.
3. Features Necessary to Adjust Use
The delicatessen is currently operating in a manner compatible with the surrounding uses.
The extension does not necessitate any additional improvements. All yards, setbacks,
landscaping, and other features necessary to adjust the delicatessen to existing and future
uses in the neighborhood have been provided and maintained.
4. Adequacy of Street System
The existing street system serving the delicatessen currently operates adequately and will
continue to be adequate to accommodate all traffic generated by the delicatessen.
V. ENVIRONMENTAL REVIEW
The Planning Director has determined that the environmental effects of the project have
already been considered in conjunction with previously certified environmental documents.
A Notice of Prior Environmental Compliance, therefore, will be issued for this amendment
and extension.

SUMMARY
All findings required for a Conditional Use Permit can still be made for this delicatessen,
therefore staff recommends that the Planning Commission approve the extension of CUP
224(A) for five years from its expiration date.
