REQUESTED ACTION: Designate Paseo Descanso from Carrillo Way to Paseo Cerro as
"No Overnight Parking" and paint red curb on Paseo Descanso at
the intersection of Carrillo Way to establish a "No Parking" zone.
BACKGROUND:
Mr. Fennel delivered a petition (attached) to staff on April 27, 2009 with his requested
actions. Also attached to this report is a January 28, 2009 letter that Mr. Fennel submitted
to the City Manager.
DATA:
Mr. Fennel lives in the corner house of a four-leg intersection. The intersection is
unusual in that each leg (street) of the intersection has a different name, as shown on
Exhibit I.
Carrillo Way and Paseo Descanso are both public streets. Paseo Privado and Via Puerta
are both private streets and, as such, are under the control of the homeowners association.
The regulation of parking issues on private streets is subject to the discretion of the
homeowner's association.
Paseo Descanso is a residential street about 0.25 miles in length that is located in the
Rancho Carrillo development, as are the other three referenced streets. Paseo Descanso
has a curb to curb width of 40 feet, which is common on most residential streets in
Carlsbad, and parking is allowed on both sides of the street. Access to Paseo Descanso is
from Carrillo Way via Melrose Drive and there is no outlet for Paseo Descanso other than
egress at Carrillo Way.
From Carrillo Way to Paseo Cerro on Paseo Descanso, there are 19 single-family homes
on the east side of the street and three single-family homes on the west side near Paseo
Cerro. A walking trail that leads from the west side of Paseo Descanso into the open
space is located between 6318 and 6322 Paseo Descanso. Concrete curb and gutter,
sidewalk, and street lights are found on both sides of Paseo Descanso.
A segment of Carrillo Way about 500 feet long is located between Melrose Drive and
Paseo Descanso. It has a curb to curb width of 40 feet with two westbound traffic lanes
near Melrose Drive and a striped median near Paseo Descanso. As a result of the striping
configuration on Carrillo Way, on-street parking is prohibited on each side of the street.

Based upon a January 2009 traffic count on Carrillo Way, the two-way 24-hour traffic
volume east of Melrose Drive is about 1,300 vehicles per day.
Via Puerta is the northerly leg of the previously referenced four-leg intersection. It is
controlled with a stop sign at Carrillo Way and is a private street that serves the Cascade
condominiums. Via Puerta is, essentially, a cul-de-sac street that is under the control of
the homeowner's association.
The easterly, fourth leg of the subject intersection is Paseo Privado, a short, private street
that includes a raised, landscaped median. This street provides access to the gated
community of homes in Montevifia. Paseo Privado is also under the control of the
homeowner's association and the HOA has prohibited parking on each side of Paseo
Privado by the installation of no parking signs.
Mr. Fennel previously contacted Transportation Division staff in June 2008 and
expressed his concerns about vehicles from the condominium complex parking on Paseo
Descanso. His request then, as now, was that a parking prohibition be established at night
upon Paseo Descanso. Mr. Fennel's request was initiated to prevent vehicles from the
Cascade condominiums from parking on Paseo Descanso (see attached e-mail dated June
2, 2008).
In June and July 2008, in response to the request by Mr. Fennel, Transportation Division
staff conducted a monitoring study of on-street parking on Paseo Descanso to assess the
situation. The study consisted of a site visit to note the location of parked vehicles on
Paseo Descanso and if any problems were observed. A total of 27 different observations
were made and observations were conducted on each day of the week. Staff found that
on the west side of Paseo Descanso, vehicles primarily parked in the segment beginning
at Carrillo Way and continued southerly to a location across from the residence at 6310
Paseo Descanso. Parking was also observed on the east side of Paseo Descanso at
various locations up to 6342 Paseo Descanso. One observation found a vehicle parked on
the east side at 6370 Paseo Descanso.
From the 27 site visits, parking was observed on the west side of Paseo Descanso 13
times. On the east side of Paseo Descanso, during the 27 observations, a parked vehicle
was observed 15 times. Vehicles were observed to be parked within 18 inches of the curb
face. Staff found no traffic engineering reason to restrict parking on the west side of
Paseo Descanso.
Mr. Fennel was notified of the findings and staffs recommendation to not implement a
parking restriction. Although vehicles from the Cascade condominiums may have been
parking near Carrillo Way on the west side of Paseo Descanso, a number of vehicles were
also parking along the east side, possibly by residents. Staff did not have the Carlsbad
Police Department "run" license plates to determine the address of the registered owner
of the vehicles being parked on either side of Paseo Descanso.

On April 8, 2009, a representative for the Rancho Carrillo Master Association and the
Cascade @ Rancho Carrillo Homeowners Association sent a letter to the City Manager's
office, attention Rob Houston (attached). The letter outlined the efforts taken by the
Associations to alleviate parking concerns on Paseo Descanso.
On April 27, 2009 Mr. Fennel submitted a petition to staff. The attached petition
contained two requests for the City Council to consider:
I. Designate Paseo Descanso as "No Overnight Parking" from Carrillo Way to
the intersection of Paseo Cerro.
2. Paint red "No Parking" curbs at the intersection of Carrillo Way and Paseo
Descanso.
In response to the April 27, 2009 petition, staff again initiated a monitoring study of
parked vehicles on Paseo Descanso. Observations were conducted 21 times and again,
there were no traffic engineering issues or problems observed that resulted from parked
vehicles. As with the previous monitoring, the largest number of vehicles were generally
parked on the west side of Paseo Descanso near Carrillo Way. The most current
monitoring study in April and May, 2009 revealed that the number of vehicles parked on
the west side of Paseo Descanso from Carrillo Way to across from the residence at 6314
Paseo Descanso ranged from one to seven. From the 21 observations, vehicles were
observed parking on the west side of Paseo Descanso 21 times and on the east side 14
times.
Although the community C.C. & R.'s may prohibit on-street parking on Paseo Descanso,
City of Carlsbad staff does not enforce the C.C. & R. 's for a homeowner's association at
any location in the city.
Attached to the petition submitted by Mr. Fennel on April 27, 2009 was a listing of other
concerns and issues. Those additional concerns are summarized as:
I. Trash/partying/noise on Paseo Descanso.
2. Oil dripping from vehicles.
3. Difficulty turning from eastbound Carrillo Way to southbound Paseo Descanso
due to parked vehicles.
4. Restricted visibility when vehicles park on both sides of Paseo Descanso.
5. Parking in the intersection.
6. Vandalism.
7. Cars for sale.
8. Parking near access to city trails is compromised.

Trash/partying/noise

Unfortunately, there are times when occupants of parked cars leave trash on the street
throughout Carlsbad both during the day and at night. If partying and noise generates
complaints, the police will respond to investigate. Carlsbad Police Department records
indicate the between January 7, 2008 and May 9, 2009, there was one report of a
disturbance/noise. Upon investigation, the officer found a vehicle car alarm going off.
Oil dripping from vehicles
Oil that has dripped to the pavement from a parked vehicle is taken seriously by the City
of Carlsbad. This unfortunate occurrence can occur during the night, or day, from a less
than optimally maintained vehicle. For this reason, and other reasons, Carlsbad's storm
water protection program maintains a storm water hotline. Residents are encouraged to
call the hotline (760-602-2799) when an illegal discharge is observed, such as oil
dripping from a vehicle. The report will be promptly investigated by staff in the Storm
Water Department and appropriate action taken against the registered owner.
Difficulty turning from eastbound Carrillo Way to southbound Paseo Descanso due to
parked vehicles
There are no unusual circumstances on Paseo Descanso to increase the overall difficulty
of a driver turning right from eastbound Carrillo Way to southbound Paseo Descanso. As
previously stated, Paseo Descanso is a 40-foot wide street that can accommodate vehicles
turning from across street to the residential street. However, to minimize the occurrence
of vehicles parking near the pedestrian disabled ramp at the southwest comer of the
intersection, staff recommends painting 30 feet of red curb on the west side of Paseo
Descanso beginning at the curb return and proceeding south. Red curb will also be
painted at the fire hydrant located on the east side of Paseo Descanso immediately south
of Carrillo Way. In addition, it is recommended that 50 feet of double yellow centerline
striping be installed on Paseo Descanso approaching Carrillo Way. The double yellow
centerline striping would terminate at the stop limit sign.
Restricted visibility when vehicles park on both sides of Paseo Descanso
Parking is allowed on both sides of this 40-foot residential street. Depending upon the
number of and location of parked vehicles, drivers must exercise caution when driving on
any residential street. With vehicles parked adjacent to the curb and gutter, one traffic
lane remains of sufficient width in each direction on Paseo Descanso.
Vandalism
Between January 7, 2008 and May 9, 2009, the Carlsbad Police Department received and
investigated one incident on Paseo Descanso of a vehicle with a window smashed.

Cars for Sale

In Carlsbad, vehicles are allowed to park on the street with a For Sale sign provided that
the vehicle is legally parked and the sign is legally affixed to the vehicle and in
compliance with city codes. Section 21.41.040 of Title 21, Zoning, in the Carlsbad
Municipal Code, provides information about signs that do not require a permit. These
type of signs include temporary signs attached to parked cars or stationary vehicles
visible from the public right-of-way.
Parking near access to city trails is compromised
The walking trail on the west side of Paseo Descanso begins behind the sidewalk at a
location between 6318 and 6322 Paseo Descanso. Vehicles parked in the street adjacent
to the curb and gutter do not block access to the trail.
Conclusion
The above discussion addresses issues that are more appropriately directed to the proper
City of Carlsbad department for corrective action. The red curb and double yellow
centerline striping will be addressed by issuance of a work order from the Transportation
Division staff to the Streets Department. Oil drippings are addressed by the Storm Water
Department. Complaints of vandalism, noise and partying should be directed to the
Carlsbad Police Department for investigation.
A traffic engineering solution, such as creating no parking at night, would not address
many of the issues that also occur in daylight hours.
RECOMMENDATION:
The Traffic Safety Coordinating Committee recommends that:
• the request for a parking restriction at night on Paseo Descanso from Carrillo Way
to Paseo Cerro be denied.
• 30 feet of curb be painted red on the west side of Paseo Descanso beginning at the
curb return.
• at the location of the fire hydrant at 6302 Paseo Descanso the curb be painted red.
• 50 feet of double yellow centerline striping be installed on Paseo Descanso
approaching Carrillo Way.
NECESSARY CITY COUNCIL ACTION:
No City Council action required if the request to have No Parking at night established on
Paseo Descanso is denied.

The Residents of Maravilla Village are concerned about the
overnight parking that has developed at the entrance to Maravilla
on Paseo Descanso.
It has been verified that these cars belong to renters in the
Cascada Condos, who are not utilizing their own garages and curb
parking for overnight parking, and are being prevented from doing
so.
This parking situation has become unsafe for walkers and
dangerous for other vehicles trying to access Maravilla. It has
also prevented guests, contractors, and persons using the walking
trails from parking on Paseo Descanso.
Because Paseo Descanso is designated a public street and Cascada
is private, our only recourse is to request the Carlsbad City
Council to intervene.
We are requesting the City Council to consider the following:
1. Designate Paseo Descanso as "No Overnight Parking" from
Carrillo Way to the intersection of Paseo Cerro.
2. Paint red "No Parking" curbs at the intersection of
Carrillo Way and Paseo Descanso.
We would appreciate your signature if you are in favor of this

SUBJECT: Recommendation to restrict parking along both sides of Paseo Descanso
to prohibit overnight parking along this street.
Recommendation:
Parking along Paseo Descanso should be designated as "Guest Only" parking with the
additional provision of "No Overnight Parking Allowed·, or '"No Parking from 12:00am to
5:00amn.
Back9round:
Three streets and three developments are involved in this situation. (See Map)
Rancho Carrillo HOA rules specifies that residents are to use their garages properly for
car parking and are not to park on the street. This same rule is in effect for the residents
of the Cascadas condominium development, too as they fall under the Rancho Carrillo
Master HOA. Each condominium unit in the Cascadas has a two garage assigned to it.
On or about, January of 2007, cars belonging to the residents of Cascada. began parking
along Carrillo Way. Until then, they did not park along this street, but parked within their
own condominium property.
We were told by their HOA that the overflow cars parking on Carrillo Way were the result
of two events. One; they had an influx of cars due to the condominiums being rented
out to 4 and 5 people per unit, and each tenant having a car meant they exceeded the
limit of a two car garage. Two; The owners who lived there repainted many of their curbs
red. They told us this was their way of keeping their streets clean and maintaining
property values. Essentially they shifted their problem to their neighbors.
After about 4 months of this parking shift from inside the Cascadas out to Carrillo Way,
the residents of Maravilla went to the city and complained of poor visibility at the
intersection of Carrillo Way and Paseo Oescanso. The cars ffom the Cascadas
residents were crowding the intersection and making it unsafe to leave-the
neighborhood The City responded by placing uNo Parking" signs along both sides of
Carrillo Way a month later .. Some of these cars reverted back to the open curbs in the
Cascadas, but many started parking along Paseo Descanso and Paseo Privada.
The Cascadas HOA then designated 40% of the open curb space as •Guest Parking
Only" around the Spring of 2008. This caused another exodus of vehicles to come out
onto Paseo Oescanso and Paseo Privada. Further compounded by even more condo
units becoming rentals to higher occupancy levels that they were designed to hold.
Beginning in February of 2008, we have asked the RC HOA to address this parking
issue with the condominium HOA in the hopes of reconciling the issue peaceably and for
the Cascadas residents to once again be able to park within their own property. The RC
HOA told us that they would start to bring it up at their meetings.

In March of 2008, a survey was conducted throughout the Maravilla development to
determine the level of concern over the parked car situation. Out of 42 homes queried,
we received 35 responses in favor of prohibiting parking along Paseo Descanso .
• In an effort to get the City of Carlsbad involved I was directed to the Engineering
department. I contacted them with our concerns over traffic safety, storm drain pollution,
and littering. Someone came out once to give a cursory glance but no action was taken
to correct our situation.
Our HOA said they would try to enforce our parking CC&R's, but then asked my wife and
me to print out notices warning the parked cars they are in violation of the CC&R's. This
just resulted in the flyers being thrown on the ground creating more trash.
In January, 2009, the Montevina neighborhood took action and was successful in getting
"No Parking Anytime" signs posted on Paseo Privada; which is the private road leading
to their development. This simply forced ALL overflow cars from The Cascadas to now
park on the west side of Paseo Descanso. The situation now reached a breaking point,
so we went back to our HOA pleading for parking enforcement and they responded that
we should "take it up with the City".
So here we are. I am asking for the City of Carlsbad to protect our neighborhood from
the excess parking on our main access street by residents of The Cascadas and others.
I cite your previous action in passing NS-884 and NS-886 as precedents for our petition.
These were passed_ in April of 2008 in response to a very similar situation with another
neighborhood and condominium complex here in Carlsbad. Aside from the "hard" Issues
mentioned below, there is also an emotional issue of protecting the value of our homes
and the integrity of our neighborhood.* We recognize that Paseo Descanso is a public
street, and that cars can park there for brief periods of time throughout the day
(gardners, UPS, etc) as well as guests coming for dinner. It is the overnight parking we
are trying to stop.
I offer the following list of concerns and supporting photographic evidence:
This 'overflow parking" has resulted in three negative outcomes that we feel can be
reversed by accepting our recommendation. These negative outcomes are:
1. Compromised driving safety
2. Environmental impact
3. Personal safety
I have attached pictures supporting points #1, #2 and #3. I would like the opportunity to
present these Images (and more) along with our case in more detail to the City Council.

Thank you for following up with this.
We have observed over the past several months an increase in the number of
cars parked along Paseo Descanso and Paseo Privada near the corner of
Carrillo Way. These two streets are the only access streets for Maravilla
and Montevina housing areas. However, these parked cars belong to residents
of the Cascada condominium development and they present driving safety
concerns and provide a harbor for drinking and littering along our street.

A year ago there were little to no cars parked along there. The Cascada
tenants/owners were able to park all of their vehicles within their
development. So what happened?
The Cascada condos' HOA enforced a parking policy and designated their curbs
for "Guest Parking" only. Primarily because one person felt parked cars
were "unsightly" and made their area look like apartments. So they were
instructed to use our streets for parking while their curbs remain empty.
(Please drive through there some evening when you see cars parked along our
streets and you can see how many open parking spaces they have within
Cascada) Ironically, Cascada residents are now taking up our guest parking
spaces, sending our guests further away. However, we have heard from some
Condo residents that they are not happy since they lost their own curb-side
parking. They now have to trek up and down our streets at night to park
their cars and cross Carrillo Way without a cross-walk, which is a safety
concern for them as well.
Therefore, in order to address these concerns we went to our HOA to change
the "Guest Parking" policy at Cascada so condo residents could once again
park along their own curbs. The homeowne~s HOA said they are trying to do
something but can't really do anything about the Cascada condo HOA policies.
They told us to take it up with the City of Carlsbad. Over 80% of the
resident's of Maravilla want southbound Paseo Descanso parking limited or
banned, even "No parking between 2:00am and 5:00am" would eliminate

overnight parking from the Cascada condo's yet still allow reasonable guest
and visitor parking times for everyone.
The 4-way intersection of Paseo Descanso/Paseo Privada/Carrillo Way and the
entrance to the condos should not have cars parked within 100 feet, in any
direction of the intersection, at the very least.

Per your request we are writing today on behalf of the Rancho Carrillo Master Association and the
Cascada @ Rancho Carrillo Homeowners Association regarding efforts taken by the Associations to
alleviate resident parking on the public streets in the Rancho Carrillo community and more specifically
on Paseo Descanso.

As per our conversation, the Association's governing documents require all owners to park vehicles in
their garage to its fullest extent. Over the past two years the Associations have experienced an increase
in rented units. With that increase also came an increase in vehicles in the community. In an effort to
reinforce the governing documents and compel all residents to adhere to the parking rules and
regulations, multiple notices were posted, mailed and hand delivered to the residents of both the single
family homes in the Master Association and the residents in the condos in Cascada. Enclosed please
find copies of these notices.
The Board of Directors for Cascada @ Rancho Carrillo has made several adjustments not only in the
parking rules and regulations but also in the community by designating "visitor" and "reserved'' spaces.
The Board is also issuing parking variances and guest passes for homes that may have more vehicles
than the garage will accommodate or who may have frequent ovemight guests. These steps were taken
in response to complaints from residents on Paseo Descanso that residents in Cascade were parking in
front of their homes at night.
To further assist in the parking issues on Paseo Oescanso the Master Association Board of Directors
designated a portion of Paseo Privado, immediately east of Pasep Descanso as a "No Parking" zone to
prevent vehicles from parking in this area.
Our main difficulty with preventing Cascada residents from parking on Paseo Descanso is that we are
unable to identify which cars go to which unit. We have requested the homeowners living on Paseo
Descanso to assist us in identifying these individuals but understandably these owners do not want to 0
confront or follow these individuals for fear of retaliation.
We hope this information is helpful in assisting the City of Carlsbad to bring a resolution to this situation.

on revising the parking rules and regulations for the Association in an effort to provide a more
understandable and reasonable policy, while maintaining a safe and a!,'tractive environment
within the community. •
Due to a high number of new tenants and some changes in property ownership, the Board has
agreed to revise the current policies.
Attached for your review is a copy of the proposed revised Parking / Towing Policy for Cascada
@ Rancho Carrillo. The Board of Directors will be voting to approve the revised policy at the
February 25, 2009 Board of Directors meeting. As per California Civil Code, the Board is
sending the proposed policy to all owners for 30 day review prior to formal approval.

This notice has been placed on your vehicle to advise you of the rules and
regulations of the Rancho Carrillo community regarding parking. We have
received multiple complaints regarding vehicles that are parked on Paseo
Descanso outside of the Cascada community. As you may or may not be aware,
the rules and regulations require that all residents of Rancho Carrillo, including
Cascada park all owned vehicles in their garage to the fullest extent possible. In
other words, all residents have a two-car garage in Cascada and are required to
park two vehicles in the garage. This also means that there should be no storage
of anything in the garage that may prevent you from parking both of your vehicles
inside. If you are an owner/tenant and have three vehicles, or issues with your
vehicle being too large to park in the garage, you must contact the Management
office immediately to apply for a parking variance.
Any residents that are noted parking on Paseo Descanso, outside the
Cascada community, can and will be called to a hearing before the Cascada
Board of Directors for possible fines to the homeowner's account. Please
understand that the Board of Directors has tried to make ttiis information
available to all tenants and homeowners throughout 2008. All homeowners
are responsible for their tenants and as such have a responsibility to
ensure that their renters are parking in the garage of the unit and nowhere
else, unless previously approved by the Board.
If you are visiting someone in Cascada, there are marked "Visitor" spaces
that can be utilized. If you will be visiting between the hours of 1 0pm to
7am, please let the person you are visiting know that they need to contact
the Management office at 760-804-5969, between the hours of 9am and 5pm
Monday thru Friday, to have them obtain a Visitor Parking Pass for your
vehicle. If you are a frequent visitor, and not living in Cascada, visitor
passes can be given for a maximum period of 90 days so that the person
you are visiting does not have to obtain a new pass every time you visit.
By utilizing the visitor spaces provided in Cascada you are helping to ensure the
safety of others in the community as well as helping to keep the community a
pleasing and attractive place to live for all.
Please be aware that your license information may be provided to the Board for
further identification. If you are a resident and are parking in this area, you are in
violation of the parking rules and will be called to a hearing before the Board for
possible fines to your or your landlord's account.
