Executive Summary The retaining wall along the northeast side of Park Drive between Bayshore Drive and the residential driveway of 4650 Park Drive was built in 1989 and needs replacement. Staff request that the City Council accept the bids for construction of the Park Drive Street and Drainage Improvements Project, Capital Improvement Program Project No. 6611, and award a contract to Wright Construction Engineering Corp for an amount not to exceed $2,725,512 and authorize additional appropriations in the amount of $400,000 for the project. Carlsbad Municipal Code Sections 3.28.080(C) and 3.28.080(I)(6), which cover purchasing in construction contracts, require the City Council’s approval for all formally bid contracts when the value exceeds $200,000, making the project subject to this requirement. Explanation & Analysis The project is needed to help stabilize the hillside along the north side of Park Drive and to mitigate surface erosion and deeper-seated instability. The existing retaining wall is degraded and requires replacement. Rainstorms cause sediment and debris to flow onto the roadway, and city crews must regularly close the sidewalk and the roadway to remove it. The wall’s current condition could force regular closures of Park Drive to ensure public safety, which curtails public access to the Agua Hedionda Lagoon. March 26, 2024 Item #4 Page 1 of 6 The project will remove about 600 feet of the existing block retaining wall and replace it with about 800 feet of a new retaining wall composed of three wall types varying in height from 2 feet to 12 feet. The project will also repair and replant portions of the slope with native plants, install pedestrian improvements along the north side of Park Drive to enhance safety and mobility and install a new stormwater filtration facility. This project will improve public safety and coastal access. •The City Council approved the project’s plans and specifications and authorized advertising the project for construction bids on Feb. 6, 2024, with the adoption of Resolution No. 2024-018. The project was then advertised using the city’s formal bidding procedures. •Staff received five bids for construction of the project on March 12, 2024. Staff reviewed the contract documents and determined that Wright Construction Engineering Corp was the lowest responsive and responsible bidder, with a bid in an amount of $2,725,512. •Wright Construction Engineering Corp was found to be responsive because its bid meets the requirements of the bidding documents and responsible because it submitted a list of similar projects to show its capability and qualification to perform the specified work. Fiscal Analysis Staff are requesting additional funding to complete the project. The project funding comes from gas tax and General Capital Construction funds. Due to the construction contract value, construction management and inspection services, and staff support costs, additional funding in the amount of $400,000 will need to be appropriated from General Capital Construction Fund to complete the project. The available funds and estimated construction costs for the project are shown in the table below: Carlsbad Municipal Code Sections 3.28.040(C)(5) and 3.28.090(B) authorize the City Manager or designee to approve change orders in an amount equal to the contingency set at the time of project award, which for this project is $650,000. The construction contract for the project provides for about eight months to complete the project improvements. In accordance with special conditions imposed by the California Coastal Commission, construction is expected to begin in May 2024 and be completed by December 2024, within the window of time allowed for construction. A notice of completion will be recorded to release bonds issued for the project once it is complete, which is expected to be by Dec. 31, 2024, Environmental Evaluation In accordance with the California Environmental Quality Act, or CEQA, and the CEQA Guidelines, the City Planner approved a mitigated negative declaration (State Clearinghouse No. 2021070586) for this project on March 30, 2022. Mitigation measures were incorporated into the design of the project and included a mitigation monitoring and reporting program so that all potentially significant impacts would be mitigated below a level of significance.
