Thank you for submitting a preliminary review for a residential project proposed on an approximately
0.26-acre (11,325-square-foot) project site, located at 2011 Escenico Terrace, currently developed with
an existing single-family residence, and attached two-car garage. The proposal generally involves the
following:
• Backyard remodel and construction of a pergola and deck over a downhill perimeter slope.
In response to your application, the Planning Division has prepared this comment letter. Please note that
the purpose of a preliminary review is to provide you with direction and comments on the overall concept
of your project. This preliminary review does not represent an in-depth analysis of your project. It is
intended to give you feedback on critical issues based upon the information provided in your submittal.
This review is based upon the plans. policies, and standards in effect as of the date of this review. Please
be aware that at the time of a formal application submittal, new plans, policies. and standards may be
in effect and additional issues of concern may be raised through a more specific and detailed review.
Planning:
1. General Plan and zoning designations for the property are as follows:
a. General Plan: R-4, Residential (0-4 dwelling units per acre).
b. Zoning: Planned Community (P-C).
c. Master Plan: La Costa Master Plan (MP 149(R)). Pursuant to City Council Ordinance No. 9476,
the development standards of the R-1 zone shall apply to this property.
2. The project requires the following permits:
a. Building Permit
3. Plans:
a. Provide a 24" x 36" site plan of the entire property showing property lines. Show a north arrow,
property lines, easements, existing and proposed structures, adjacent structures, streets,
existing/proposed street improvements, right-of-way width, lot width/depth, gross/net lot
size, dimensioned setbacks, and existing topographical lines (including all side and rear yard
slopes). Provide the legal description of property and assessor's parcel number. Please see
Information Bulletin 1B-201 for a list of minimum requirements for site plans:

b. Lot Coverage: Please include an existing and proposed line-item lot coverage calculation on
the cover sheet of all structures contributing to the lot coverage including roof eaves extending
over thirty-inches or more, stairs, and decks more than 30 inches in height. Include both the
proposed deck and pergola in the lot coverage calculation. Please note that the allowable lot
coverage in the R-1 Zone is no more than forty percent.
c. Setbacks: In the R-1 Zone, interior lots shall have a front yard setback on 20 feet, and a side
yard on each side of the lot which has a width that is ten percent of the width of the lot;
provided, that such side yard shall be not less than five feet in width and need not exceed ten
feet. On the plans, please show how the proposed attached pergola complies with the required
setback. Please note that lot width is measured at the 20-foot front yard setback. Pursuant to
Carlsbad Municipal Code (CMC) Section 21.04.245{1), a line 10 feet in length within the lot and
farthest removed from the front lot line and at right angles to the line comprising the depth of
such lot shall be used as the rear lot line.
d. Elevations: Please include the proposed height and overall dimensions of the proposed deck
and pergola on the elevation sheet.
e. Fencing: Pursuant to CMC Section 21.95.140(1)(4), fencing proposed along a slope edge should
be of an open design which does not visually extend the height of the slope. Please ensure any
proposed fencing complies with this standard.
4. Hillside Development Regulations. CMC Section 21.95.140 prohibits residential development on
downhill perimeter slopes over forty percent gradient with an elevation differential greater than
fifteen feet. In accordance with CMC Section 21.95.130, a constraints map illustrating a slope analysis
and slope profiles must be included with the building plan submittal for any proposed development
on slopes which have a gradient of fifteen percent or more and have an elevation differential greater
than fifteen feet. If it is determined the slope meets or exceeds the above-noted thresholds, the
proposed deck cannot be supported.
5. Landscape Plan Check. If the proposed landscaping is included on the building plan submittal, the
plans will be required to undergo landscape plan check given the total landscaped area for the
development is 500 square feet or more. If the landscaping is removed from the building permit plans,
no landscape plan check will be required.
6. New requirements related to the city's goals to reduce greenhouse gas (GHG) emissions will likely
impact development requirements of this project. A formal application submittal will need to include
a completed Climate Action Plan Checklist (Form P-30} to determine what requirements will apply to
the project. New GHG reduction requirements are related to energy efficiency, photovoltaic, electric
vehicle charging, water heating and traffic demand management requirements, as set forth in the
California Green Building Standards Code and in CMC Chapters 18.21, 18.30 and 18.51 which is
available on the city's website at the following address:

To the extent that new GHG reduction requirements are in effect at the time of application for grading
or building permits, the project will be required to comply with the effective requirements even if
different than what is proposed in the project's planning approvals. GHG reduction requirements may
impact, but are not limited to, site design and local building code requirements. If incorporating new
GHG reduction requirements results in substantial modifications to the project after planning
approvals are obtained, then prior to issuance of grading or building permits, the applicant may be

required to submit and receive approval of a Consistency Determination or an Amendment
application for the project through the Planning Division.
All necessary application forms, submittal requirements, and fee information are available at the Planning
counter located in the Faraday Building at 1635 Faraday Avenue or online at
https://www.carlsbadca.gov/departments/community-development/planning. You may also access the
General Plan Land Use Element and the Zoning Ordinance online at the website address shown. Please
review all information carefully before submitting.
Land Development Engineering:
l. Complete a Stormwater Standards Questionnaire Form E-34. This questionnaire will guide you and
the city in determining what type of reports and storm water mitigation must be completed to satisfy
state and City storm water quality requirements. The questionnaire is located on the City of Carlsbad
website.
2. Based on a preliminary analysis it appears that this project will be a Standard Project. Complete the
Standard Project Requirement Checklist, Form E-36, and show all source and site design BMPs on the
conceptual grading and drainage plans.
3. Provide a Preliminary Title Report (current within the last six (6) months).
4. Annotate and delineate all existing easements and encumbrances listed in the Preliminary Title Report
on the site plan. If any vacations or quitclaims are planned with this development annotate on the
site plan.
5. This project shall utilize City of Carlsbad Survey Control Network established on Record of Survey
Map 17271, NAD83, Zone VI, 1991.35 Epoch for horizontal control and NGVD 29 datum for vertical
control per City of Carlsbad Engineering Standards.
6. Delineate and annotate the limits of grading and add grading quantities in cubic yards, even if the
only grading proposed is for the pier footings.
7. Delineate and annotate approximate topographic contours for existing and proposed condition.
Provide 1-foot contours for slopes less than 5%; 2' intervals for slopes between 5% and 10%, and 5'
intervals for slopes over 10%. Extend contours a minimum 25 feet beyond the project boundary.
8. Clarify with a cross section through the deck whether the deck will be entirely or partially supported
by piers or a retaining wall. If walls are proposed, show top of wall and bottom of wall elevations,
including at the highest and lowest points. Indicate maximum height of retaining wall measured from
bottom of footing to top of wall and maximum height measured from finish surface to top of wall.
9. Show existing lot line bearing and distance.
10. Please be advised that a more in-depth review of the proposed development will occur with the
discretionary permit application when a more complete design of the project is provided.
Building Division:
1. Building Division has no objection to the conceptual renderings. However, applicant states they wish
to build on their back slope. The building code would require a foundation for a dwelling to be either

the smaller distance between H/3 and 40 feet. The proposal is not for a dwelling or habitable
structure, nevertheless, given soils and hillside slope instability any building plan submittal shall
require a registered design professional to design the footings and the structural design of said footing
validated/evaluated by a soils engineer. Additional details of attachments and connections and spans
of materials will be required.
Fire Department:
1. Not in a fire hazard severity zone. No additional Fire comments or concerns.
