Council Chamber 1200 Carlsbad Village Drive Carlsbad, CA 92008 PLEDGE OF ALLEGIANCE: Council Member Luna led the Pledge of Allegiance. ANNOUNCEMENT OF CONCURRENT MEETINGS: City Council is serving as the City of Carlsbad City Council and the Carlsbad Municipal Water District Board of Directors on Consent Calendar Item No. 3. APPROVAL OF MINUTES: Minutes from the Regular Meeting held March 19, 2024 Motion by Mayor Pro Tern Bhat-Patel, seconded by Council Member Acosta, to approve the minutes as presented. Motion carried unanimously, 5/0. PRESENTATIONS: Proclamation in Recognition of Asian American Pacific Islander Month Mayor Pro-Tern Bhat-Patel presented the proclamation to Program Manager Pat Downie. PUBLIC REPORT OF ANY ACTION TAKEN IN CLOSED SESSION: City Attorney Cindie McMahon announced that in a Closed Session held at 4:15 p.m. the City Council voted unanimously to authorize the initiation of litigation of one case. Once the litigation has formally commenced, information about the litigation including the defendant and other particulars will be disclosed upon inquiry unless the disclosure would jeopardize the City's ability to serve an opposing party or jeopardize the City's ability to conclude any existing settlement negotiations to its advantage. PUBLIC COMMENT: City Soccer Club Carlsbad Academy Director Jeff Hughes spoke regarding the soccer league girls winning teams. Tim Morgan spoke regarding a Valley Middle School net that blocks views. CONSENT CALENDAR: Motion by Mayor Pro Tern Bhat-Patel, seconded by Council Member Acosta, to approve Consent Calendar Item Nos. 1 through 6. Motion carried unanimously, 5/0. 1. REIMBURSEMENT FOR TRAINING COSTS OF REGIONAL URBAN SEARCH AND RESCUE TASK FORCE 13 PROGRAM -Adoption of Resolution No. 2024-087 authorizing the City Manager or designee to execute an agreement with the California Office of Emergency Services for the reimbursement of costs associated with the Regional Urban Search and Rescue Task Force 13 May 7, 2024 Carlsbad City Council Regular Meeting Page 2 program and to execute such future reimbursement agreements. (Staff contact: Kevin Lynds, Fire Department) 2. AWARD OF CONTRACT TO CALTEC CORP FOR THE SCHULMAN AUDITORIUM AUDIO-VISUAL UPDATE PROJECT AND AUTHORIZING AN ADDITIONAL APPROPRIATION. CIP PROJECT NO. 4753 -Adoption of Resolution No. 2024~088 accepting bids, authorizing relief of the bid submitted by EIDIM Group, Inc. and awarding a contract to CALTEC CORP for the Schulman Auditorium Audio-Visual Update Project in an amount not to exceed $2,222,222 and authorizing an additional appropriation in the amount of $1,170,000 from the Infrastructure Replacement Fund. FOR CONSTRUCTION OF THE VALLEY STREET WATER MAIN REPLACEMENT AND THE FOXTAIL LOOP SEWER REPLACEMENT PROJECTS -CIP PROJECT NOS. 5503 and 3904 -1) Adoption of Resolution No. 2024-089 accepting the bid and a~arding a contract to Basile Construction, Inc. for construction of the Foxtail loop Sewer Replacement Project in an amount not to exceed $670,060; and 2) Adoption of a Carlsbad Municipal Water District Board of Directors Resolution No. 1731 accepting the bid and awarding a contract to Basile Construction, Inc. for construction of the Valley Street Water Main Replacement Project in an amount not to exceed $360,614. FOR ENGINEERING DESIGN AND CONSTRUCTION SUPPORT SERVICES FOR THE FARADAY AVENUE IMPROVEMENTS PROJECT, CIP PROJECT NO. 6099 -Adoption of Resolution No , 2024-090 accepting proposals and awarding an agreement to Michael Baker International, Inc. to provide engineering design and construction support services for the Faraday Avenue Improvements Project in an amount not to exceed $140,145. TERMINATION OF PROCLAMATION OF A STORM -RELATED LOCAL EMERGENCY FOR REMOVAL OF SEDIMENT AND VEGETATION ON THE BUENA VISTA CREEK CONCRETE CHANNEL NEAR EL CAMINO REAL -Adoption of Resolution No. 2024-091 terminating the proclamation of a storm-related local emergency for removal of sediment and vegetation in the Buena Vista Creek Concrete Channel near El Camino Real. CONTINUATION OF PROCLAMATION OF A STORM-RELATED LOCAL EMERGENCY FOR REPAIR OF THE SLOPE BETWEEN EL CAMINO REAL AND TRIESTE DRIVE -Adoption of Resolution No. 2024-092 continuing the proclamation of a storm-related local emergency for repair of the slope between El Camino Real and Trieste Drive. FISCAL YEAR 2024-25 ANNUAL ACTION PLAN FOR THE COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM -1) Hold a public hearing; and 2) Adoption of Resolution No. 2024-093 approving the Community Development Block Grant Program Fiscal Year 2024-25 Annual Action Plan for submission to the U.S. Department of Housing and Urban Development. (Staff contact: Nicole Piano-Jones, Community Services Department) City Manager's Recommendation: Take public input, close the public hearing and adopt the resolution. Senior Program M_anager Nicole Piano-Jones presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). Mayor Blackburn opened the duly notice~ public hearing at 5:25 p.m. Seeing no one wishing to speak on this item, Mayor Blackburn closed the duly noticed public hearing at 5:25 p.m. Motion by Mayor Pro Tern Bhat-Patel, seconded by Council Member Acosta, to adopt Resolution No. 2024-093. Motion carried, 5/0. DEPARTMENTAL AND CITY MANAGER REPORTS : 8. CITY FLEET UPDATE -Receive a report on the state of the city's fleet, economic and operational impacts, and next steps for the Fleet Division in fiscal year 2024-25. (Staff contact: Bradley Northup, Public Works Department) City Manager's Recommendation: Receive the report. Public Works Superintendent Bradley Northup presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). City Council received the report. 9. NEW APPROACH TO PRIORITIZING AND FUNDING INFRASTRUCTURE, PARKS AND OTHER MAJOR CONSTRUCTION PROJECTS -Receive an update on changes to how the city manages its Capital Improvement Program, a 15-year plan for how the city develops, schedu.les, phases and requests funding for major city infrastructure projects, new parks, city buildings and other public improvements. May 7, 2024 Carlsbad City Council Regula r Meeting Page 4 City Manager Scott Chadwick, Deputy City Manager of Public Works Paz Gomez and Senior Management Ana lyst Craddock Stropes presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). In re sponse to Mayor Blackburn, City Manager Chadwick explained that the change to the planning prioritizing and funding will not affect enterprise projects. In response to Council Member Acosta, Finance Director Zach Korach explained that the City is switching its approach to a five-year focus, correlating with the city's Five-Year Strategic Plan and they will continue to have a 15-year funding schedule but capital improver:nent projects will be tied to the five-year time horizon. In response to Council Member Luna, Finance Director Korach explained that the cash in the fund balance is actively invested within the City's general investment portfolio. Mayor Blackburn requested that staff organize the PowerPoint differently so Council can explain the Capital improvement Program better to residents. City Council received the update. COUNCI L REPORTS AND COMMENTS: Mayor Blackburn and the City Council Members reported on activities and meetings of some committees and subcommittees of which they are members.
