HomeMy WebLinkAbout2024-07-16; City Council; Resolution 2024-172RESOLUTION NO. 2024-172 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ACCEPTING BIDS AND AWARDING A CONSTRUCTION CONTRACT TO VSS INTERNATIONAL, INC. IN AN AMOUNT NOT TO EXCEED $6,640,120 FOR THE 2023 SLURRY SEAL PROJECT, CAPITAL IMPROVEMENT PROGRAM PROJECT NO. 6001-23SS WHEREAS, the City Council of the City of Carlsbad, California has determined it necessary, desirable and in the public interest to construct the 2023 Slurry Seal Project, Capital Improvement Program, or CIP, Project No. 6001-23SS, or Project; and WHEREAS, on May 14, 2024, the City Council adopted Resolution No. 2024-101, approving the plans, specifications and contract documents and authorizing advertisement for construction bids for the project; and WHEREAS, on June 20, 2024, staff received four bids for construction of the Project; and WHEREAS, VSS International, Inc. submitted the lowest responsive and responsible bid to construct the project, in an amount not to exceed $6,640,120; and WHEREAS, the Project funding sources include non-jurisdictional fees, which are generated from trash haulers, gas tax and TransNet local funds, and sufficient funding is available in the account for the Pavement Management Program, CIP Project No. 6001, to complete the Project; and WHEREAS, Carlsbad Municipal Code, or CMC, Sections 3.28.080{C) and 3.28.080(1)(6), which cover purchasing in construction contracts, require that the City Council award all formally bid contracts when the value exceeds $200,000; therefore, the Project is subject to this requirement; and WHEREAS, CMC Sections 3.28.040(C)(5) and 3.28.090{8) authorize the City Manager or designee to approve change orders in an amount equal to the contingency set at the time of project award, which is $1,400,000 for the Project; and WHEREAS, the City Planner determined on April 5, 2024, that the slurry seal project qualified for an exemption under California environmental Quality Act, or CEQA, Guidelines Section 15301{c) - Existing Facilities. A notice of intended decision regarding the environmental determination for this project was advertised and posted on the city's website. No comment letters or appeals were received and, consistent with CMC Chapter 21.54 -Procedures, Hearings, Notices, and Fees, the City Planner's written decision is final. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the lowest responsible and responsive bid of $6,640,120 submitted by VSS International, Inc. for construction of the 2023 Slurry Seal Project, CIP Project No. 6001- 23SS, is accepted, and the Mayor is hereby authorized to execute the contract for the Project. 3. That the City Manager or designee is authorized to approve construction change orders up to $1,400,000 for the Project. 4. That the award of this contract is contingent upon VSS International, Inc. executing the required contract and submitting the required bonds and insurance policies, as described in the contract, within 20 calendar days after adoption of this Resolution. The City Manager may grant reasonable extensions of time to execute the contract and assemble the required bonds and insurance policies.
