HomeMy WebLinkAboutCD 2024-0008; PRECISION MEDICAL GENERATOR ADDITION; Admin Decision LetterJuly 15, 2024 TARA NORTON RBN DESIGN 9445 FARNHAM STREET, SUITE 101 SAN DIEGO, CA 92122 \Ccityof Carlsbad SUBJECT: CD 2024-0008 (DEV2024-0037) -PRECISION MEDICAL GENERATOR ADDITION Dear Ms. Norton, The City Planner has completed a review of your application for Consistency Determination, CD 2024- 0008, which is a modification to Site Development Plan, SDP 97-08(8) and Special Use Permit, SUP 97- 05(8) -CARLSBAD CORPORATE CENTER-PARCEL C, located at 5860 El Camino Real (APN 209-050-32-00). After careful consideration of the request, the City Planner has determined that the request meets all the findings below and APPROVES this request. The proposed modifications include: • The addition of a mechanical equipment enclosure (approximately 170 square feet) for the installation of a new 100-Kw generator and 200-amp automatic transfer switch (approximately 6-feet-7-inches-tall) surrounded by a 6-foot-8-inch-tall masonry screen wall using split face block to complement the materials of the existing building. The proposed generator and enclosure will occupy an area of existing landscaping adjacent to the 105,185- square-foot industrial building. No parking spaces are proposed to be removed, and the mechanical equipment enclosure will be setback 30 feet from El Camino Real, as required by SUP 97-05(8). In order for a Discretionary Permit Consistency Determination to be approved, all of the following findings must be made: 1) No project condition, feature, facility or amenity is changed or deleted that had been considered essential to the project's design, quality, safety or function. 2) The request represents an upgrade in overall design features and or materials and improves upon the project's compatibility with the surrounding neighborhood, in that the proposed screen walls associated with the mechanical equipment enclosure utilize building materials, specifically split-face blocks, that are architecturally compatible with the existing building and are of a height (6 feet 8 inches) that will adequately screen the proposed equipment contained within (6 feet 7 inches). 3) The proposed revision does not change the density or boundary of the subject property. 4) The proposed revision does not involve the addition of a new land use not shown on the original permit. July 15, 2024 ·,, J j air. : Pa e2 • ..., • 5) The proposed revision does not rearrange the major land uses within the development, in that no additional building floor area or other uses are proposed beyond the scope of what was approved under the original Site Development Plan, SOP 97-08(8) and Special Use Permit, SUP 97-05(8). 6) The proposed revision does not create changes of greater than ten percent provided that compliance will be maintained with the applicable development standards of the Carlsbad Municipal Code, in that no addition of internal floor area or building height is proposed, and that only 170-square-feet of 10,459-square-feet (1.6%) of landscaping is proposed to be removed. In addition, the mechanical enclosure remains compliant with the requirements of the El Camino Real Corridor Development Standards by not encroaching into the 30-foot landscape setback from El camino Real. 7) The proposed change will not result in any significant environmental impact, and/or require additional mitigation, in that the proposed improvement does not create any inconsistencies or new impacts relative to the environmental review process associated with the original project's approval. 8) The proposed change would not result in any health, safety or welfare impacts. 9) There were not any major issues or controversies associated with the original project which would be exacerbated with the proposed change, in that the proposed mechanical equipment enclosure utilizes building materials, specifically split-face blocks that will be compatible with the earth tone color scheme of the existing building. 10) The proposed change would not be readily discernable to the decision makers as being substantially different from the project as originally approved, in that the proposed mechanical equipment enclosure utilizes building materials, specifically split-face blocks that will be compatible with the earth tone color scheme of the existing building. The new the enclosure will maintain the general design, quality, and function of the original project. Therefore, the City Planner has determined that the application qualifies for a consistency determination with the approved permit and approves the changes to the project based on Planning Division Administrative Policy No. 35. NOTICE Please take NOTICE that approval of your project includes the "imposition" of fees, dedications, reservations, or other exactions hereafter collectively referred to for convenience as "fees/exactions." You have 90 days from the date of final approval to protest imposition of these fees/exactions. If you protest them, you must follow the protest procedure set forth in Government Code Section 66020(a), and file the protest and any other required information with the City Manager for processing in accordance with Carlsbad Municipal Code Section 3.32.030. Failure to timely follow that procedure will bar any subsequent legal action to attack, review, set aside, void, or annul their imposition. This decision may be appealed by you or any other member of the public to the Planning Commission within ten days of the date of t_his letter. Appea Is must be submitted in writing to the Planning Division at 1635 Faraday Avenue in Carlsbad, along with a payment of $900.00. The filing of such appeal within such time limit shall stay the effective date of the order of the City Planner until such time as a final decision on the appeal is reached.
