Receive a report from the Chief of Police regarding recent events in the City of Carlsbad.
Fiscal Analysis
This action has no fiscal impact.
Environmental Evaluation
This action does not require environmental review because it does not constitute a project within
the meaning of the California Environmental Quality Act under California Public Resources Code
Section 21065 in that it has no potential to cause either a direct physical change in the
environment or a reasonably foreseeable indirect physical change in the environment.

•U.S Supreme Court overruled Martin v. Boise with its 6-3 decision in Grant Pass
•Holding: Criminal enforcement of anti-camping ordinances does not violate the 8th
Amendment’s prohibition on Cruel and Unusual Punishment
•Martin v. Boise requirement that there be sufficient shelter beds for the unhoused
prior to enforcement no longer applicable
•Opinion does not obviate legal risk to cities in criminally enforcing anti-camping
ordinances
•Both Majority and Dissent favorably discuss Oregon’s statute imposing
“objective reasonableness” standard on all anti-camping ordinances

BURGLARY TOURIST ARREST &

•Carlsbad Police made an arrest of 3 individuals on January 25, 2024 after
burglarizing a residence in the southern end of the city
•Subjects wanted for similar crimes in other states
•Subjects were from Chile and Italy and found to be entering the U.S through the Visa
Waiver program
•Subjects were arrested and charged with conspiracy, residential burglary, identity
theft and resisting arrest
•Two subjects sentenced to 6 years in prison and one subject sentenced to 4 years in
prison
•Heavy lift by Investigations, Crime Suppression Team, Patrol & Crime Analysis =
GREAT SUCCESS!!

-Presented to Council on June 18th by
City Attorney’s Office and Legislative
Constituent Services Director
-Motion passed by Council to put Prop H
on the ballot in November for the voters
decide
-If passed, will increase the expenditure
limit for using funds to acquire or
improve real property, add an inflation
index to the limit, and exempt public
safety facilities from limit.
