SUBJECT: CUP-42(I) -CARLSBAD RACEWAY CORP. -Request for
approval of an amendment to a conditional use permit to
allow the sale of beer at special events held at
Carlsbad Raceway.
I. RECOMMENDATION
It is recommended that the Planning Commission ADOPT Resolution
No. 2093, APPROVING CUP-42(I), based on the findings and subject
ot the conditions contained therein.
II. PROJECT DESCRIPTION AND BACKGROUND
The applicant is requesting approval of an amendment to his
conditional use permit to allow the sale of beer, from beer
stands, at special events held on the Raceway. These special
events would include the Motocross event, usually in late June,
the Superbike event, usually in late October, and a maximum of
three additional events at other times throughout the year. All
special events would take place during daylight hours. This
request does not pertain to the regularly scheduled Saturday
night drag races.
A similar request has been made on two previous occasions. In
August, 1966 and again in April, 1981, the Planning Commission
denied such a request to sell beer. Both denials were based
primarily upon Police Department opposition. The Police noted
that the overwhelming majority of incidents.at the Raceway were
alcohol-related and that high Police manpower levels would be
necessary.
Since that time, the City Council has approved a policy whereby
the Police may charge promoters of events for additional Police
services that may be necessary to maintain the public safety.
The applicant has agreed to pay for any additional Police staff
that the Chief of Police may deem necessary. Since the
applicant, and not the City, would be paying for this manpower,
the Police Department no longer opposes the sale of beer.
III. ANALYSIS
Planning Issue
1) Will the requested sale of beer at special events
jeopardize the public safety?
Discussion
Staff believes that the proposed amendment, as conditioned, will
assure sufficient protection of the public safety. The Police
Chief will be advised at least 45 days prior to the date of any
special event and will have final authority over the level of
security provided each event. Since the Police Department
believes that these conditions will result in adequate crowd
control, staff is recommending approval of CUP-42(I).
IV. ENVIRONMENTAL REVIEW
The Land Use Planning Manager has determined that this project
is categorically exempt from environmental review according to
Section 19.04.070(6)(C) of the Carlsbad Environmental Ordinance
and, therefore, issued a Notice of Exemption on March 7, 1983.
