The request is for a conditional use permit to allow an
animal kennel and associated supervisory buildings on properties
north of Ponto Drive between the A.T. & S.F. Ratlroad right~of~
way and Carlsbad Boulevard.
The property ts presently zoned "Mu (Industrial}. A 60~
private unimproved right~of-way easement provides access to
the subject property as well as tne two parcels directl1 across
the street.
Item E, subsection 6 of section 21.42.010 (permttted uses}
establishes the requirement of a conditional use permtt for an
animal kennel within industrtal zones.
Section 21.32.010 paragraph (ll 11 ••• A dwe11i~g conforming
to the yard requirements of the R .. 3 zone shall be permttted on
the same lot on which a factory is located, and which dwelling
is used exclusively by a caretaker or superintendent of such
factory and his family.N
The existing city ordinances allow a kennel, but the ordi-
nances do not p~ovide for dwellings to be used exclusively by
a caretaker, owner or superintendent.
Specific uses presently on the property are indicated on
the attached map. The uses consist of the kennel facility, a
caretaker's trailer and the owner's present residence.
The applicant wishes to construct a new residence and
utilize the former residence as an office and the existi~9
trailer for a caretaker~ livtng quarters. The ordinance does
not allow for new construction.

The subject property does not have adequate water for
fire fighting. Addttionally it is approximately 5 mtles
from a fire station and rear access to the·prop~rty is over
an unimproved 60 1 private right-of-way easement.
Recommendations
The staff recommends approval of the subject application
subject for the following reasons and subject to the followtng
conditions. •
Reasons:
1. The proposed use is in conformance with the General Plan of
the City of Carlsbad.
2. The proposed use meets all criteria set by the City of
Carlsbad zonine ordinance (Ord. 9060).
3. The proposed construction of a new dwelltng unit and the
upgrading of the property will add appreciably to the character
of the neighborhood.
Conditions:
l. That the proposed kennel operation include only existing or
proposed permanent structures.
2. That the proposed new structure, a dwelling unit, be con~
structed to conform to normal residential yard requtrements
per Ordinance 9060.
3. That the existing dwelling be utt11zed only for office space
and a potential living unit for an on-stte caretaker.
4. That all existing structures to be retained satisfy the
existing City of Carlsbad building code~
5. Dedicate 30 1 easement for one~half a publfc street adjotntng
the property on the easterly side. ~ignment to be subject to
city e~gineer
6. Construct full subdivision improvements as required by Ctty
ordinance and the City Engineer for that one-half street fronting
on the subject property.
7. Participate in construction of water main wtth ftre hydrants,
as required by the City Engineer.
8. Applicant may enter into a future improvement agreement for
the construction of satd improvement.

9. The applicant shall enter into a future improvement agree~
ment with the City for participation in the installation of
sewers to serve the area, in accordance with the master plan.
10. The above conditions are to be satisfied prior to issuance
of a building permit.
11. That all fine prevention devices be constructed in con-
formance with requirements set by the City of Carlsbad fire
chief.
