HomeMy WebLinkAbout1973-01-09; Planning Commission; ; CUP 64 - EUGENE CHAPPEE AUTO REPAIR FACILITYSTAFF REPORT /MEMOI rnuM January 9, 1973 TO: PLANNING COMMISSION FROM: PLANNING DEPARTMENT SUBJECT: CITY COUNCIL ACTION ON THE CHAPPEE REQUEST FOR CONDITIONAL USE PERMIT -------------------------------------------· --------------------- The City Council, on November 21, 1972, c6nsidered an appeal of the Planning Commission's decision denying a Request for a Conditional Use Permit to allow an Auto Wrecking Yard submitted by Eugene c~ Chappee. The City Council granted the appeal of t~e Planning Commission's decision as outlined below: "A motion was made that the appeal be granted for a Conditional Use Permit for the operation of an Auto Wrecking and Dismantling Yard for a period of ten (10) years, subject to the following con- ditions: 1. That a future street improvement agreement between the City of Carlsbad and the applicant be entered into covering the total westerly front of Parcel #16. 2. That the applicant install a water main and one fire hydrant, said fire hydrant to be located to the satisfaction of the tity Fire Chief. 3. That the height limitation of stacked material from ground level not exceed 20 feet, as agreed by the applicant. 4. That landscaping on the northeasterly boundary be accomplished for screening purposes, as agreed by the applicant, and subject to the City's Environmental Protection Ordinance. 5. That the approval of applicant's request be subject to the resolution of a parcel split of subject property. • Councilman Lewis indicated he was not opposed to the CUP being granted but felt the time limit of ten years was too long and a period of seven years should be the maximum time limit for this CIJP.11 .The Planning Commission decision to deny the Chappee application (August 27, 1972) was based on: 1. The Ponto area is in a state of flux and transition. Property to the east is currently under a Planned Community Master Plan. The· first phase, 55 acres, is developing· as a 386 unit mobile home park. 2. The entire section of the Carlsbad Planning Area south of Palomar Airport Road between the Pacific Ocean and easterly limits of the CMWD boundary is presently under an active General Plan Review. -Staff Report/Memo 1dum Chappee Cond. Use ~ermit Page 2 .January 9, 1973 3. The proposed C.U.P. is not in conformance with the existing General Plan. Simultaneously, the Commission requested that an Environmental Impact Statement be submitted prior to final approval. Additionally, the Commission felt that existing problems in the Ponto area should • -not be compounded at the present time. And,that the proposed General Plan Revision should be completed prior ~o final decision. This application has been returned to the Planning Commission for report. The Planning Commission may either reaffirm its original decision, or may concur with the City Council decision granting the appeal with conditions. Proposition 20 and the intent to· provide a Master Plan for the Coastal Zone reflect another consideration. An adopted statewide Master Plan is required by 1975. The City is also proposing a General Plan Revision to be completed in twelve (12) months (January, 1974). Therefore, any time designation for land use in the Ponto area should reflect Planning Commission review subsequent to the projected com- pletion of the Coastal Zone Master Plan and the City of Carlsbad General Plan Revision. w DONALD Planning Dir dr
