I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 3634 APPROVING CUP 90-13xl based upon the findings and subject to the conditions contained therein. H. PROJECT DESCRIPTION AND BACKGROUND On February 20, 1991, the Planning Commission approved the subject project which consists of a 1 O' X 20' trailer, a circular decomposed granite driveway, chemical toilets, a picnic table, and three parking spaces located on County owned land in the M-Q zone. The project, a government facility funded by the City, requires a conditional use permit. The project is located west of the County access road utilized by the Water District and Coast Waste Management. ~ During the past three years, the hiring center11~ntinued its employment operation, providing employment to approximately 3,224 • workers during 1993. On average, the hiring center provides employment services to 40 individuals daily during the hours of 7:00 a.m. to 12:00 noon Monday through Sacurday. " Although the conditional use permit was approved for two years until February 21, 1993 to correspond with a two year lease with the County, the actual lease was negotiated for the period from July 1991 through June 1993. The County has since agreed to automatic: an.T'lual lease renewals with the City until either agency terminates the lease. The City Council has approved funding of the project through June, 1994, and the Hiring Center will be included in the 1994-95 proposed budget. The project has not been returned to the Planning Commission for extensp~il lease renewrJ and funding issues were finalized. ANALYSIS The Hiring Center has continued to operate for the past three years as conditioned with three minor exceptions. The first exception involves a condition requiring that Hiring Center kiosk plaques be placed on all structures located along Palomar Airport Road and El Camino Real. Due to the high cost of directional plaques, alternate City signage was utilized to reduce costs. The second exception is a minor alteration of the site due to the installation of 6 posts necessary to support a 128 square foot plywood awning above the outdoor tables adjacent to the trailer. The cover is necessary to provide shade and shelter during inclimate weather, and the necessary building supplies and labor will be provided by the Center through donations. Although the cover will be supported by wood posts set in concrete, there is no cement slab involved allowing for easy removal should the project be discontinued. The Hiring Center is temporarily using a blue tarp attached to the posts to provide shelter above the tables and chairs which is far less desirable than the proposed cover conditioned to be painted to match the trailer. The third exception is the onsite parking spaces. Although the original conditional use permit specified five parking spaces, only three spaces are actually provided on-site. Jim Lundgren, Hiring Center manager, has indicated that this is sufficient parking for the three permanent staff members, however, one additional employee from the State Department of Employment does park on the street. Mr. Lundgren indicated that approximately 50% of the individuals seeking employment drive automobiles to the site, and there is sufficient area within the site's boundaries along the western shoulder of the road to accommodate the approximately 20 individuals who drive to the Center each day. Parking parallel to the roadway does not obstruct two way circulation and traffic safety is ensured because the private road is not heavily used by the surrounding governmental uses. Parking is not permitted east of the roadway thereby providing off-road pedestrian access to the site. DISCUSSION The findings previously made to approve the Hiring Center conditional use permit remain the same. The use is necessary and desirable to promote the health, safety and welfare of the community because it provides an employment center with safe vehicular and pedestrian access away from residential areas for the increasing numbers of migrant workers who solicit employment along roadways, intersections and parking lots. The Hiring Center is compatible with the surrounding industrial and governmental uses which provide services and have similar onsite storage requirements. The site is adequate to accommodate the use, and the necessary amenities including the proposed awning have·or will be provided. The street system serving the project is adequate to provide access to the facility for pedestrians as well as automobiles. In summary, the Planning Department recommends that the Planning Commission approve a five year extension of CUP 90-13 as conditioned including the deletion of Condition No. 5 requiring a fifth onsite parking space and Condition No. 7 requiring kiosk signage. ,. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 3190 APPROVING CUP 90-13 based upon the findings and subject to the conditions contained therein. II. PROJECT DESCRIPTION AND BACKGROUND In February, 1990, the City Council directed staff to research migrant hiring site alternatives to address the problem of large numbers of documented and undocumented workers who congregate along streets and intersections and commercial parking lots seeking employment. The increasing numbers of migrant workers soliciting jobs from passing motorists have raised citizen concern about loitering, traffic and pedestrian safety, and resulted in complaints from local business owners who are concerned that large numbers of workers congregating in parking lots and at store entrances is resulting in property and business loss. In April, 1990, after investigating hiring site operations in other cities, Council authorized staff to begin investigating potential hiring site locations satisfying the following criteria: 1. a non-residential area; 2. provides maximum vehicular and pedestrian traffic safety; 3. close proximity to public transportation. Staffs site investigation resulted in the selection of a .83 acre site located on County owned land just east of the Carlsbad Municipal Water District facility and west of Coast Waste Management in the M-Q zone. The proposed hiring center is a government facility requiring the approval of a Conditional Use Pennit to operate at the proposed location. The proposed project consists of a 1 O' X 20' office trailer, a circular decomposed granite driveway, two chemical toilets, picnic tables, bicycle racks, and five parking spaces available only to hiring center employees and potential employers. Minimal grading (approximately 240 cubic yards) is necessary to accommodate the use. Access to the site is provided by a 24' wide County road which intersects with El Camino Real and Faraday Avenue. The proposed hours of operation are CUP 90-13 City of Carlsbad Hiring Center February 20, 1991 Page 2 6:00 a.m. to 11:00 a.m. Monday through Friday, and 7:00 a.m. to 12:00 p.m. on Saturday. The hiring center will be staffed by a bi-lingual project supervisor and two placement specialists contracted by the City. m. ANALYSIS Planning Issues 1. Can the four findings required for granting a Conditional Use Permit for the hiring center in the M-Q zone be made? Specifically: a. That the requested use is necessary or desirable for the development of the community, is essentially in harmony with the various elements and objectives of the General Plan, and is not detrimental to existing uses or to uses specifically permitted in the zone in which the proposed use is to be located; b. That the site for the intended use is adequate m size and shape to accommodate the use; c. That all of the yards, setbacks, walls, fences, landscaping, and other features necessary to adjust the requested use to existing or permitted future uses in the neighborhood will be provided and maintained; and d. That the street system serving the proposed use is adequate to properly handle all traffic generated by the proposed use. DISCUSSION As determined by the City Council, the proposed use is necessary and desirable to promote the health, safety, and welfare of the community because it provides an employment center with safe vehicular and pedestrian access away from residential areas for the increasing numbers of migrant workers who solicit employment along roadways, intersections and parking lots. The proposed use in the M-Q zone is surrounded by industrial and governmental uses such as the Safety Center and Fire Station, Coast Waste Management, and the Carlsbad Municipal Water District, each requiring equipment storage onsite. The hiring center is not detrimental to these uses since it is also a City facility offering a needed service and requiring the storage of a temporary office trailer onsite. The .83 acre relatively flat, previously graded parcel with access provided by a 24 foot wide County access road is adequate in size and shape to accommodate the proposed use. CUP 90-13 City of Carlsbad Hiring Center February 20, 1991 Page 3 The parcel will require minimal grading to create a 7,000 square foot pad to locate the small office trailer, circular driveway, picnic tables, chemical toilets, and employee/employer parking; the majority of the parcel will not be disturbed. The parcel's triangular shape provides adequate frontage along the access road to enable a one-way circular driveway for safe ingress and egress to the project. Also, the site is located in a non-residential area surrounded by other governmental and industrial uses and set back from major roadways and intersections providing greater pedestrian and vehicular traffic safety which satisfies the site selection criteria used by staff to identify appropriate hiring center sites. The proposed project includes no permanent structures, however, the temporary office trailer and chemical toilets will be screened from El Camino Real along the western side by 8 -10 foot redwood trellises. Directional signage on the City's kiosk structures along Palomar Airport Road and El Camino Real in Spanish and English is being required to direct potential employees and employers to the site. Additional signage must meet the City's sign ordinance standards. The street system serving the proposed hiring center includes Faraday Avenue, a secondary arterial, and a County owned and maintained access road which runs diagonally from Faraday Avenue to El Camino Real. The proposed site design includes a one-way circular driveway with a northern entrance approximately 50 feet south of the Coast Waste Management driveway and an exit 100 feet south of the project entrance. This circular driveway design precludes cars from backing out onto the private road from the hiring center thereby ensuring greater traffic safety. The access road is primarily used by Coast Waste Management trash disposal trucks and the Carlsbad Municipal Water District. Since parking along the east side of the private access road will be prohibited and no onsite employee parking will be provided, hiring center vehicular traffic on this road should be limited to staff and potential employers. Daily bus service is available within one quarter mile of the center along El Camino Real from the northern and southern City boundaries. Safe pedestrian access to the site is provided along Faraday Avenue and the County access road. Growth Management The subject site is located in Local Facilities Management Zone 5, however, Chapter 21.090.160(a) of the Zoning Ordinance exempts City projects from Growth Management requirements. SUMMARY Based on the above discussion the proposed use is consistent with General Plan Elements, is compatible with surrounding uses, and can be adequately accommodated at the proposed site. ENVIRONMENfAL REVIEW Sections 15303(c) and 15304(c) of the California Environmental Quality Act (CEQA) state that a small temporary structure involving only minor alteration to the existing landform is exempt from environmental review. Conditions: 1. 2. Approval is granted for CUP 90-13 for two (2) years, as shown on Exhibit(s) "A'1 and "B", dated February 20, 1991, incorporated by reference and on file in the Planning Department. Development shall occur substantially as shown unless otherwise noted in these conditions. This conditional use permit is granted for a period of 2 years. This conditional use permit shall be reviewed by the Planning Director on a yearly basis to determine if all conditions of this permit have been met and that the use does not have a significant detrimental impact on surrounding properties or the public health and welfare. Staff will return to the Planning Commission in one year with a report detailing these findings. If the Planning Director determines that the use has such significant adverse impacts, the Planning Director shall recommend that the Planning Commission, after providing the permittee the opportunity to be heard, add additional conditions to mitigate the significant adverse impacts. This permit may be extended for a reasonable period of time not to exceed 5 years upon written application of the permittee made no less than 90 days prior to the expiration date. In granting such extension, the Planning Commission shall find that no substantial adverse affect on surrounding land uses or the public's health and welfare will result because of the continuation of the permitted use. If a substantial adverse affect on surrounding land uses or the public's health and welfare is found, the extension shall be considered as an original application for a conditional use permit. There is no limit to the number of extensions the Planning Commission may grant. 3. Any signs proposed for this development shall at a minimum be designed in conformance with the City's Sign Ordinance and shall require review and approval of the Planning Director prior to installation of such signs. 4. "No Parking'' signs shall be installed per City standards along the east side of the County access road between Faraday Avenue and El Camino Real. 5. A fifth parking space shall be added along the southern property line. The three parking spaces closest to the trailer shall be designated for hiring center employee parking only. 6.
