SUBJECT: CUP 90-13x2 -CARLSBAD HIRING CENTER -Request for a retroactive
CUP extension to allow the continued operation of a hiring center on property
generally located on the west side of Orion Street between Faraday Avenue and El
Camino Real in Local Facilities Management Zone 5.
I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolution No. 5439
APPROVING a retroactive extension of CUP 90-13xl based upon the findings and subject to
the conditions contained therein.
II. INTRODUCTION
This proposed five year and five month retroactive extension and five year extension of CUP 90-
l 3x l will retroactively extend CUP 90-13xl from February 21, 1998 to July 16, 2003 and allow
the continued operation of the Carlsbad Hiring Center from July 16, 2003 through July 15, 2008.
III. PROJECT DESCRIPTION AND BACKGROUND
On February 21, 1990, the Planning Commission approved CUP 90-13 for two years to allow a
Hiring Center that would provide a centralized location for those seeking temporary employment
in the City. On March 2, 1994, the Planning Commission approved CUP 90-13x 1 to allow the
Carlsbad Hiring Center to continue to operate on Orion Street between Faraday Avenue and El
Camino Real in the northeast quadrant of the City. Condition No. 2 of the approving CUP
Resolution No. 3634 specifies that CUP 90-13x I is granted for a period of 5 years through
February 21, 1998, and that it may be extended upon written application of the permittee (City of
Carlsbad). Staff is recommending a 5 year and 5 month retroactive extension and five year
extension of CUP 90-13xl from February 21, 1998 to July 15, 2008.
IV. ANALYSIS
A. The Carlsbad Hiring Center continues to be consistent with all applicable plans, policies
and regulations described below:
1. Carlsbad General Plan;
2. Local Facilities Management Plan 5;
3. Title 21 of the Carlsbad Municipal Code; and
4. Any other pertinent plans, policies or regulations.

The adopted project findings for CUP 90-13xl, which are contained m Planning
Commission Resolution No. 3634 still apply to this project (CUP 90-13x2).
The adopted project conditions for CUP 90-13x 1, which are contained in Planning
Commission Resolution No. 3634 still apply to this project (CUP 90-13x2) with the
exception of Condition No. 2 which is replaced by Conditions No. 3 and 4 of Planning
Commission Resolution No. 5439 to extend CUP 90-13xl through July 15, 2008.
No formal written complaints regarding CUP 90-13x 1 have been submitted to the City.
According to the attached Hiring Center Summary Report prepared by Community
Development, the Hiring Center is operating successfully and its services have been
beneficial to the community.
Annual reviews have been conducted for CUP 90-13xl and the project is in compliance
with all conditions of approval.
ENVIRONMENTAL REVIEW
The Planning Director has determined that this project is exempt from the requirements of the
California Environmental Quality Act (CEQA) per Section 15301, Existing Facilities, of the
State CEQA Guidelines and will not have any adverse significant impact on the environment.

HIRING CENTER REPORT
SUMMARY
January 1, 2002 through December 31, 2002
Hiring Center Placements
• For the calendar year 2002 the Hiring Center placed a total of 2,771 workers into
jobs. A total of 2,355 individuals (85%) were placed into "day work" situations,
122 (4%) were placed into jobs lasting 2 and 4 days, 67 (3%) into jobs lasting
longer than 5 days (not permanent), and 227 (8%) were placed into permanent
positions.
Employer Information
• The reporting period shows that 281 new employers have registered with the
Hiring Center. A total of 2,251 job orders were placed for the 2002 calendar
year; 371 orders were placed by employers driving out to the Center, another
1,356 placed their orders by telephone, and 11 employers faxed their orders to
the Hiring Center.
• Approximately 67% of the employers was homeowners looking for day laborers.
Other employers (33%) have hired workers to fill jobs in areas such as
construction, landscaping, and industrial/manufacturing.
• Of those employers utilizing the Hiring Center for this reporting period, 45% are
from Carlsbad, 24% are from the Oceanside area, 8% are from Vista, 11 % from
Encinitas, and the remainder were from other areas of the county or out-of-state.
Employee Information
• A total of 330 potential employees registered at the Center for this reporting
period. Approximately 81 % of those registered could be classified as immigrants,
and the remainder (19%) was United States citizens. Approximately 37% of the
employees registered were women.
• Most of the employees utilizing the Center's services are from Mexico (76%), 5%
were from other countries and 19% are from the United States.
• Fifty-three percent (53%) of the workers registering at the Center own a personal
vehicle, 46% registering rode the bus, and 1 % car pooled or biked to the Center.

• The average starting wage for all employees was $8.04 per hour.
• During this reporting period 19% of the workers registered live in Carlsbad, 42%
are from Oceanside, 5% are from Encinitas. The remaining 34% reside in other
areas such as San Marcos, Escondido, Fallbrook and Vista.
Employee Usage/Placements
• During this calendar year the number of individuals registering each month has
increased compared to calendar year 2001. The average number of individuals
who have registered at the Center during this reporting period of 2002 is 28.
• Permanent placements have decreased over the same time frame as for
calendar year 2001 . The average number of individuals placed for 2002 is 19
each month compared to the average of 28 placed each month for 2001 .
• For this reporting period January, June and September had the highest number
of individuals registering for work at the Center.

THE HIRING CENTER ON PROPERTY GENERALLY LOCATED
EAST OF EL CAMINO REAL AND SOUTH OF FARADAY
AVENUE.

WHEREAS, a verified application has been filed with the City of Carlsbad
and referred to the Planning Com.mission; and
WHEREAS, said verified application constitutes a request as provided by
Title 21 of the Carlsbad Municipal Code; and
WHEREAS, pursuant to the provisions of the Municipal Code, the Planning
Commission did, on the 2nd day of March, 1994, hold a duly noticed public hearing to
consider said application on property described as:
Portion of Lot B, Map 823, Rancho Agua Hedionda
WHEREAS, at said public hearing, upon hearing and considering all
testimony and arguments, if any, of all persons desiring to be heard, said Com.mission
considered all factors relating to CUP 90-13xl.

2. Adequate onsite parking is provided within the western shoulder of the roadway
ensuring traffic safety since two way circulation is not obstructed and the roadway
is not heavily used by the surrounding governmental uses.
Conditions:
1. Conditions 1 through 4 and 6 imposed upon CUP 90-13 as stated in Planning
Commission Resolution 3190 shall apply as conditions of approval for CUP 90-
13xl except as amended by Condition 2 and 3 below. Condition No's. 5 and 7 of
Planning Commission Resolution No. 3190 are deleted.
2. This conditional use pennit is granted for a period of five years, from February 21,
1993 through February 21, 1998. This conditional use permit shall be reviewed
by the Planning Director on a yearly basis to detennine if all conditions of this
pennit have been met and that the use does not have a significant detrimental
impact on surrounding properties or the public health and welfare. If the Planning
Director determines that the use has such significant adverse impacts, the Planning
Director shall recommend that the Planning Commission, after providing the
permittee the opportunity to be heard, add additional conditions to mitigate the
significant adverse impacts. This permit may be revoked at any time after a public
hearing, if it is found that the use has a significant detrimental affect on
surrounding land uses and the public's health and welfare, or the conditions
imposed herein have not been met. This pennit may be extended for a reasonable
period of time not to exceed five years upon written application of the permittee
made no less than 90 days prior to the expiration date. In granting such
extension, the Planning Commission shall find that no substantial adverse affect
on surrounding land uses or the public's health and welfare will result because of
the continuation of the permitted use. If a substantial adverse affect on
surrounding land uses or the public's health and welfare is found, the extension
shall be considered as an original application for a conditional use permit. There
is no limit to the number of extensions the Planning Commission may grant.
3. The 128 square foot table awning shall be painted and maintained to match the
existing trailer and shall be removed upon discontinuance of the use.

That the requested use is necessary or desirable for the development of the
community, is essentially in harmony with the various elements and objectives of
the general plan because it promotes the health, safety, and welfare of the
community by addressing the problem of documented workers seeking employment
along streets and intersections in residential neighborhoods; and is not detrimental
to existing uses or to uses specifically permitted in the zone in which the proposed
use is to be located because existing surrounding uses are similar in use to the
proposed use;
That the site for the intended use is adequate in size and shape to accommodate
the use since its large triangular shape provides adequate frontage allowing safe
ingress and egress and adequate area for the proposed project with the majority
of parcel remaining undisturbed.
That all of the yards, setbacks, walls, fences, landscaping, and other features
necessary to adjust the requested use to existing or permitted future uses in the
neighborhood will be provided and maintained;
That the street system serving the proposed use is adequate to properly handle all
traffic generated. by the proposed use since the County owned and maintained road
providing access to the hiring center is minimally used, and the proposed use will
generate little additional traffic.

Approval is granted for CUP 90-13 for two (2) years, as shown on Exhibit(s) 11A'1
and 11B11, dated February 20, 1991, incorporated by reference and on file in the
Planning Department. Development shall occur substantially as shown unless
otherwise noted in these conditions.
This conditional use permit is granted for a period of 2 years. This conditional use
permit shall be reviewed by the Planning Director on a yearly basis to determine

welfare. Staff will return to the Planning Commission in one year with a report

3. Any signs proposed for this development shall at a minimum be designed in
conformance with the City's Sign Ordinance and shall require review and approval
of the Planning Director prior to installation of such signs.
4. "No Parking'' signs shall be installed per City standards along the east side of the
County access road between Faraday Avenue and El Camino Real.
5. A fifth parking space shall be added along the southern property line. The three
parking spaces closest to the trailer shall be designated for hiring center employee
parking only.
6. The site shall be maintained so that it is free of trash and debris prior to closing
each day.
7. "Hiring Center'' Kiosk plaques shall be provided on all Kiosk structures located
along El Camino Real and Palomar Airport Road concurrently with the opening of
the hiring center.
