I. REQUEST: That the Planning Commission approve a Conditional
Use Permit to allow the establishment of a mobile home ~s
a temporary Bank facility on property located in the C-2
4one District.
II. ORDINANCE REQUIREMENTS -Pursuant to Sec. 21.42010 (5) (S)
a mobile home may be utilized as a temporary office in any
zone except residential subject to a C.U.P. The use of
the temporary office is to be limited to a one year period
unless extended by tha Planning Commission. In order to
grant a C.U.P. the following facts must be found to exist:
(1) That the requested use is necessary" or desirable
for the development of the community, is essenttally
in harmony with the various elements and objectives
of the general plan, and is not detrimental to
existing uses or to uses specifically permitted in
the zone in which the proposed .use is to be located;
(2) That the site for the intended use is adequate
in size and shape to accommodate the use;
(3) That all of the yards, setbacks, walls, fences,
landscaping, and other features necessary to
adjust the requested use to existing or permitted
future uses in the neighborhood will be provided
and maintained;
(4) That the street system serving the proposed use
is adequate to properly handle all traffic generated
by the proposed use.
III. STAFF RECOMMENDATION:· That it be moved that the Planning
Commission approve CUP-95 subject to the conditions outlined
below~ Justification is based upon:

1. The facts required by the Ordinance necessary to
grant a C.U.P. do exist since the proposed bank
use is a permitted use in the C-2 zone and is .
in conformance with the General Plan. Because of
time constraints placed upon Banks by other agencies,
temporary offices must be utilized to activate
licenses to permit a bank use. Therefore, it is
desirable to permit the use of a temporary office.
In addition, the permanent bank location conforms
to a previously approved Specific Plan (SP-141
and 146 -See attached)~ During the consideration
of this Specific Plan, many of the required
factors were found to exist, such as adequacy of
street system, compatibility to other uses, and
adequacy of setbacks, landscaping, etc.
A. Conditions of Approval:
1. Prior to issuance of any permits, all require-
ments of C.C. Resolution No. 3304 necessary
to permit the proposed temporary facility
shall be completed in a manner acceptable to
the Planning Director and City Engineer.
2. The approval is granted for the land described
in the application and any attachments thereto,
and as shown on the plot plan submitted labeled
Exhibit A. The location of all buildings,
fences, signs, roadways, parking areas, land-
scaping, an~other facilities or features
shall. be located substantially as shown on the
plot plan labeled Exhibit A, except or ·unless
indicated otherwise herein.
3. Any minor change may be approved by the Planning
Director. Any substantial change will require
the filing of an application for an amendment
to be considered by the Planning Commission.
4. All requirements of arty law, ordinance or
regulation of the State of California, City
of Carlsbad and any other governmental entity
shall be complied with.
5. All areas shown as parking areas shall be
surfaced with asphaltic concrete and shall be
visibly marked outlining individual parking
spaces and traffic flow. Said surfacing and
marking shall be completed prior to final in-
spection of the structure or structures by
the Building Department. The surface shall
be kept 1 n a reaso·nab l y good state of rep a 1 r
at all times.
6. • Prior to obtaining any building permit and
within 30 days hereof, the applicant shall file
with the Secretary of the Planning Commission
written acceptance of the conditions stated
herein.
7. Any mechanical and/or electrical equipment to
be located on the roof of the structure shall
be screened in a manner acceptable to the
Planning Director. Detailed plans for said
screening shall be submitted, in triplicate,
to the Planning Director
8. All lighting shall be arranged to reflect away
from adj.oining properties and streets.
9. An incombustible trash enclosure shall be
provided of a size and location acceptable to
the Planning Director, and said area shall be
enclosed with a fence and/or wall of sufficient
height to· adequately shield the area. Said
fence and/or wall shall include a solid gate.
10. A detailed landscape and sprinkler plan pre-
pared by a landscape architect, shall be
submittJd to the Planning Director for con-
sideration and approval.
11. Prior to final building inspection clearance,
all landscaping shall be installed. Said
landscaping shall, at all times, be maintained
in a manner acceptable to the Planning Director.
12. All utilities including electrical, telephone
and cable television, shall be installed under-
ground and/orshall be completely concealed
from view.
13. All public improvements shall be made in conform-
ity with the Subdivision Ordinance and other
City Standards, to the satisfaction of,the
City Engineer, without cost to the City of
Carlsbad and free of all liens and encumbrances.
14. Prior to any construction, the applicant shall
submit plans to the appropriate entity pro-
viding domestic water to the proposed develop-
ment, for its approval of the location, type
and adequacy of water lines, and to this
Fire Department for approval of the location of
fire hydrants.
15. Prior to final occupancy, compliance with and
execution of all conditions listed hereon shall
be necessary, unless otherwise specified. De-
viation from this requirement shall be permitted
only by written consent of the Planning Director.
IV. BACKGROUND:

This CUP is granted for a one year period
of time ending April 23, 1975.f Prior to
the end of said period of time and .
upon pending expiration of this CUP the
applicant may request tha~ the Planning
Commission review \he nc~~:nfor a possible extension of time.r ~
The CUP shall expire when the use for which
it is granted is discontinued for a period of
30 consecutive days or more.
18. This approval is granted to the applicant
only, and is not assignable to others.
19. Wherever in the opinion of the Planning
Director it is appropriate, parking lot
improvements and landscaping that would be
utilized by the ultimate development shall
be permanently installed.
20. Any signs installed shall conform to the requirements of Chapter 21.41 of the
Municipal Code and shall be considered
temporary to be removed upon removal of
the temporary facility or occupancy of the
permanent facility whichever occurs first . •

V. DISCUSSION OF SPECIFIC REQUEST: The applicant is proposing
to utilize an existing 2460 sq. ft. mobile office. Said
structure is to be modified by the addition of a tile roof
and stucco to the exterior to conform to the motif along El
Camino Real. A total of seven parking spaces are proposed
which do exceed the Ordinance requirements.
The proposed location of the temporary facility is within
the right of way of Osuna Drive. In order tb accomplish
this, an encroachment permit would have to be processed
through the City of Carlsbad.
