SUBJECT: DI 95-01 - PLANNING COMMISSION PROCEDURES - Review and
readoption of Planning Commission Procedures.
I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolution No. 3768
APPROVING DI 95-01, adopting amended Planning Commission Procedures.
11. DISCUSSION
On May 3, 1995 and on May 17, 1995, the Planning Commission considered the first set
of comprehensive changes to the Planning Commission Procedures since 1989. At its
meeting May 3, 1995, the Commission discussed and agreed to seven additional minor
modifications and then continued the matter to May 17, 1995, in order to further discuss
three issues or topics. These included: 1) retention of audio tape recordings; 2)
selection of the chairperson on a rotational basis; and 3) continuing matters to a date
uncertain.
Items one and three were resolved at the hearing May 17, 1995. The remaining item
dealt with election of the Chairperson. The existing language in the Carlsbad Municipal
Code section 2.24.050 provides that the Planning Commission "shall elect from among its
appointed members a chairman and vice-chairman to serve for a term of one year." The
Chairperson recommended that Commissioner Emin's proposed language be returned to
the Commission as version (a); staff to return with language which would be version (b);
and any other Commissioners who wished to proposed language, would be version (c).
Staff would propose that the wording from the CMC is sufficient, and if the Commission
chooses, the wording could be incorporated into Resolution No. 3768 either as a new
separate section, or rename an existing section and incorporate the above language into
an existing section.
At the time of printing, staff had not received any proposed language from any of the
other Commissioners.

Options include, but are not limited to the following: 1) - consider Commissioner Erwin's
proposal. The Assistant City Attorney has reviewed said proposal, and (as he understands
it), it will merely "inform" the manner in which the election takes place. He further stated
that it seems to be consistent with, not a replacement for, the ordinance process. A key
point is that elections must occur annually. 2) - If the Commission chooses, the language
which is in the CMC could be incorporated into the Planning Commission Procedures. In
addition to this language, it could further state that there is no restriction of the number of
terms an individual may serve or on re-elections. Once again, the key is that there shall be
annual elections.
Changes have been made to page 6 of Resolution No. 3768, incorporating the revised
method of dealing with Planning Commission audio tapes, which was approved by
Commission at its meeting May 17, 1995.
Additionally, on page 7 of the Planning Commission minutes from the last meeting, (in the
next to last and second to last paragraphs), two suggestions for change were made, but not
voted on. If the Commission wishes to incorporate these suggested revisions/additions, they
should be incorporated into an approving motion.

Method of Selecting Planning Commission Chair
It is the intention of the Planning Commission to provide an opportunity for each duly appointed Commissioner to serve
as Chairperson of the Planning Commission. The Chair has no
policy-making or administrative powers beyond that of the Plann-
ing Commission as a whole.
Opportunity
1. Whenever possible, each Planning Commissioner should have the opportunity to serve as Chairperson within his/her first appointed term. 2. A Planning Commissioner may decline to serve as Chair.
Eliqibility
1. A Planning Commissioner should not serve as Chair more than once within the same appointed period.
2. A newly appointed Planning Commissioner should serve a
minimum of two years on the Planning Commission before
being eligible to serve as Chair.
3. When a Planning Commissioner is re-appointed to a new term, and the Planning Commissioner has served as Chair during the preceding term, a minimum of two years should elapse before the Planning Commissioner is eligible to serve as Chair a second time.
