Recommended Action
Adopt a Carlsbad Municipal Water District Board of Directors resolution approving a quitclaim
deed of easement over Assessor Parcel Number 213-020-18, located at the McClellan-Palomar
Airport.
Executive Summary
Easements provide the Carlsbad Municipal Water District Board with access to private property
to install or maintain public infrastructure. Staff are requesting the Board of Directors’ approval
to terminate, or “quitclaim,” a water easement that provided the district access to land at the
County of San Diego’s McClellan-Palomar Airport, at 2198 Palomar Airport Road, as shown in
Exhibit 2.
The water lines at the airport have been realigned, so the district no longer needs this
easement. Only the CMWD Board of Directors has the authority to quitclaim the easement.
Explanation & Analysis
The County of San Diego granted the easement to the Carlsbad Municipal Water District, or
CMWD, in 1970. Public water pipelines were constructed to serve the airport and its tenants.
This easement was granted to CMWD for a public water distribution pipeline and related
facilities.
The water distribution system at the McClellan-Palomar Airport was realigned in 2022 with a
new easement as part of the Palomar Airport Water Line Realignment Project (Capital
Improvement Program Project No. 5055-1). That project replaced aged piping at the airport.
The realignment maintains the existing water supply capacity, provides CMWD’s operations
staff with better access to the system for regular maintenance and minimizes the need to shut
down the system when repairs are required.

Staff recommend the CMWD Board approve the grant of a quitclaim deed of easement of the
water line easement to the County of San Diego.
Fiscal Analysis
There are no fiscal impacts with quitclaiming this easement. No fees are required to process
this quitclaim deed of easement.
Next Steps
Upon approval by the CMWD Board of Directors, the Secretary of the Board will record the
quitclaim deed of easement in Exhibit 1, Attachment A, and other required recording
documents with the San Diego County Office of the Recorder.
Environmental Evaluation
The City Planner, through the process outlined in Carlsbad Municipal Code Section 19.04.060,
has determined that this action does not require environmental review under California
Environmental Quality Act Guidelines Section 15301(b) - Existing facilities, because the
quitclaim deed does not constitute an expansion of an existing use and has no potential to
cause either a direct physical change in the environment or a reasonably foreseeable indirect
physical change in the environment.

RESOLUTION NO. 1746
A RESOLUTION OF THE BOARD OF DIRECTORS OF THE CARLSBAD
MUNICIPAL WATER DISTRICT OF THE CITY OF CARLSBAD, CALIFORNIA,
APPROVING A QUITCLAIM DEED OF EASEMENT OVER ASSESSOR PARCEL
NUMBER 213-020-18, LOCATED AT THE MCCLELLAN-PALOMAR AIRPORT
WHEREAS, the Carlsbad Municipal Water District, or CMWD, Board of Directors of the City of
Carlsbad, California, adopted a resolution accepting bids and awarding a contract for construction of
the Palomar Airport Water Line Realignment, Capital Improvement Program Project No. 5055-1 at the
County of San Diego's McClellan-Palomar Airport; and
WHEREAS, the project relocated and abandoned existing water lines located within an
easement dedicated to the CMWD by the County of San Diego, for water line purposes and described
as parcels 1 and 2 and a portion of Parcel 3 in the grant deed of easement recorded April 3, 1970; and
WHEREAS, the water easement is no longer required for the purpose for which it was granted,
nor will it be needed for any future public water purpose; and
WHEREAS, the CMWD Board of Directors has determined it necessary, desirable and in the
public interest to approve a quitclaim deed of easement to the County of San Diego for the water line
easement; and
WHEREAS, the City Planner, through the process outlined in Carlsbad Municipal Code Section
19.04.060, has determined that this action does not require environmental review under California
Environmental Quality Act Guidelines Section 15301{b) because the quitclaim deed of easement does
not constitute an expansion of an existing use and has no potential to cause either a direct physical
change in the environment or a reasonably foreseeable indirect physical change in the environment.
NOW, THEREFORE, BE IT RESOLVED by the CMWD Board of Directors of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That the quitclaim deed of easement, attached hereto as Attachment A, on file with the
Secretary of the CMWD Board of Directors and incorporated herein by reference, is
approved.
3. That the CMWD Board President is authorized to execute the quitclaim deed of easement
attached hereto as Attachment A, and the Secretary of the CMWD Board of Directors is
hereby authorized to record said document.
