A RESOLUTION OF THE BOARD OF DIRECTORS OF THE CARLSBAD
MUNICIPAL WATER DISTRICT OF THE CITY OF CARLSBAD, CALIFORNIA,
APPROVING A QUITCLAIM DEED OF EASEMENT OVER ASSESSOR PARCEL
NUMBER 213-020-18, LOCATED AT THE MCCLELLAN-PALOMAR AIRPORT
WHEREAS, the Carlsbad Municipal Water District, or CMWD, Board of Directors of the City of
Carlsbad, California, adopted a resolution accepting bids and awarding a contract for construction of
the Palomar Airport Water Line Realignment, Capital Improvement Program Project No. 5055-1 at the
County of San Diego's McClellan-Palomar Airport; and
WHEREAS, the project relocated and abandoned existing water lines located within an
easement dedicated to the CMWD by the County of San Diego, for water line purposes and described
as parcels 1 and 2 and a portion of Parcel 3 in the grant deed of easement recorded April 3, 1970; and
WHEREAS, the water easement is no longer required for the purpose for which it was granted,
nor will it be needed for any future public water purpose; and
WHEREAS, the CMWD Board of Directors has determined it necessary, desirable and in the
public interest to approve a quitclaim deed of easement to the County of San Diego for the water line
easement; and
WHEREAS, the City Planner, through the process outlined in Carlsbad Municipal Code Section
19.04.060, has determined that this action does not require environmental review under California
Environmental Quality Act Guidelines Section 15301(b) because the quitclaim deed of easement does
not constitute an expansion of an existing use and has no potential to cause either a direct physical
change in the environment or a reasonably foreseeable indirect physical change in the environment.
NOW, THEREFORE, BE IT RESOLVED by the CMWD Board of Directors of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That the quitclaim deed of easement, attached hereto as Attachment A, on file with the
Secretary of the CMWD Board of Directors and incorporated herein by reference, is
approved.
3. That the CMWD Board President is authorized to execute the quitclaim deed of easement
attached hereto as Attachment A, and the Secretary of the CMWD Board of Directors is
hereby authorized to record said document.
