I. RECOMMENDATION That the Planning Commission ADOP'f Planning Commission Resolution No. 3724, recommending APPROVAL of LCPA 94-02, based on the findings and subject to the conditions contained therein. II. ITEM EXPLANATION The Commission heard the staff presentation on this item at its meeting of December 7, 1994 and continued it to the meeting of December 21, 1994, due to the lateness of the hour. PROJECT DESCRlfflQN AND BACKGROUND During this year, two affordable housing zone code amendments (i.e. ZCA 93-05, Senior Citizen Housing and ZCA 92-04, Second Dwelling Units) were approved by the Carlsbad City Council as follows: ZCA 93-05 -Amended the density provisions for Senior Citizen Housing projects to conform to State Density Bonus Law and established locational guidelines and design and development standards which respond to senior citizen needs; and ZCA 92-04 -Modified the processing requirements and development standards for second dwelling units for purposes of encouraging and enabling the development of second dwelling units in the residential zones of the City. In that the City's Zoning Ordinance as approved by the California Coastal Commission functions as the implanentin1 ordinance for the City's Local Coastal Program (LCP), the previously approved zone code amendments also require an amendment to the LCP. This Local Coastal Program Amendment (LCPA) is a follow-up discretionary action to the previously approved zone code amendments and will result in consistency between the City's Zoning Ordinance and the LCP. Upon approval of this Local Coastal Program Amendment, it will be submitted to the California Coastal Commission for approval. A six week public comment period was provided for the proposec1· Local Coastal Prognm Amendment beginning on October 20, 1994 and ending on December 2, 1994. A notice was published in the Carlsbad Sun and the Blade Otizen. A copy of the notice was also mailed to • the interested parties list maintained by the City. No comments were received. Will this Local Coastal Program Amendment affect other sections of Carlsbad's certified Local Coastal Programs? 2. Will this Local Coastal Program Amendment significantly impact coastal resources? DISCUSSION Any proposal to develop Senior Citizen Housing or Second Dwelling Unit(s) within the Coastal Zone, pursuant to the amended zoning regulations shall be required to comply with all other applicable Local Coastal Program policies and provisions. Therefore, no effects on other LCP sections are anticipated. This proposed LCPA, which will add new zoning provisions applicable to Senior Citizen Housing and Second Dwelling Unit projects, is not anticipated to result in significant impacts to coastal resources. As discussed above, any Senior Citizen Housing or Second Dwelling Unit project proposed within the Coastal Zone, shall be required to comply with all applicable LCP policies and provisions, including those dealing with the protection of coastal resources. IV. ENVIRONMENTAL REVIEW Negative Declarations were approved for the two Zone Code Amendments which are the topic of this LCPA as follows: ZCA 93-05 -Senior Ctizen Housing -April 19, 1994; and ZCA 92-04 -Second Dwelling Units -June 14, 1994. This project (LCPA 94-02) is a follow up legislative action to these zone code amendments. Since LCPA 94-02 will not revise the environmental findings of the previously approved Negative Declarations, the Planning Director has determined that this project will not have a significant effect on the environment and, therefore has issued a Notice of Prior Compliance on October 19, 1994.
