It is the Planning Commission's Policy to adjourn the meeting no later than 10:00 p.m .. 2. Meetings are divided into categories shown below. 3. When you are called to speak, please come forward and state your name and address. 4. Persons with a disability may request an agenda packet in appropriate alternative formats as required by the Americans with Disabilities Act of 1990 by contacting the City Manager's office at 760-434-2821 (voice), 711 (free relay service for TIY users), 760-720-9461 (fax) or manager@carlsbadca.gov by noon on the Friday preceding the meeting. PLEASE NOTE: Any agenda related writings or documents provided to the majority of the Planning Commission after distribution of the Agenda packet will be available for public inspection at the Planning Division located at 1635 Faraday Avenue, Carlsbad, CA 92008. In addition, a binder containing all agenda related writings and documents will be held by the Minutes Clerk at each Planning Commission meeting and available for public review. 6. VISUAL MATERIALS FOR PLANNING COMMISSION: Visual materials should be submitted to the Planning Division at 1635 Faraday Avenue no later than noon on the day of a Regular Planning Commission Meeting. Digital materials will be placed on a computer in Council Chambers for public presentations. Please label all materials with the agenda item number you are representing. Items submitted for viewing, including presentations/digital materials, will be included in the time limit maximum for speakers. All materials exhibited to the Planning Commission during the meeting {slid~es, maps, photos, etc.) are part of the public record and must be kept by the Planning Division for at least 60 days after final action on the matter. Your materials will be returned upon written request. Video clips cannot be accommodated. 7. Meeting Decorum: Carlsbad Municipal Code sections 1.20.320 and 1.20.330 require members of the public to observe order at this meeting and to conduct themselves in a courteous manner. California Penal Code section 403 makes it a misdemeanor for any person to willfully disturb or break up any assembly or meeting with lawful authority. PUBLIC COMMENT: If you desire to speak about an item not listed on the agenda, a "Time Reservation Request:" form should be filed with the Minutes Clerk. A total of 15 minutes is provided for the Public Comment portion of the Agenda. Speakers are limited to three (3) minutes each. COP 15-25-4394 YUKI LANE-Request for approval of a Coastal Development Permit to allow for the construction of a 3,532 square foot single family residence with attached three-car garage within the Mello II Segment of the city's Coastal Zone located at 4394 Yuki Lane within Local Facilities Management Zone 1. The project site is not within the appealable area of the California Coastal Commission. The City Planner has determined that the project belongs to a class of projects that the State Secretary for Resources has found do not have a significant impact on the environment, and it is therefore categorically exempt from the requirement for the preparation of environmental documents pursuant to Section 15303{a), construction of a single family residence, ofthe state CEQA Guidelines. RESOLUTION NO. 7155 STAFF RECOMMENDATION: Approval PLANNER: Greg Fisher ENGINEER: David Rick PLANNING COMMISSION ACTION: Approved 5-0-1 (Commissioner L'Heureux) 2. SUP 15-02-AGUA HEDIONDA CREEK RESTORATION-Request for approval of a Floodplain Special Use Permit to restore a section of Agua Hedionda Creek by removing existing grouted rip-rap, controlling erosion by reducing incoming storm water flow velocities, replacing the culvert outfall ramp with ungrouted riprap, and replanting the stream banks with native riparian habitat. This project is generally located at 5855 Sunny Creek Road and within a portion of the Agua Hedionda Creek in Local Facilities Management Zone 15. The City Planner has determined that the project belongs to ~~ class of projects that the State Secretary for Resources has found do not have a significant impact on the environment, and it is therefore categorically exempt from the requirement for the preparation of environmental documents pursuant to Section 15333{d){5) of the state CEQA Guidelines -stream or river bank stabilization with native vegetation or other bioengineering techniques, the primary pUirpose of which is to reduce or eliminate erosion and sedimentation. SP 186(E)-HOEHN MOTORS AUTO RETAIL DISTRICT-Request for a recommendation of approval of a Specific Plan Amendment SP 186(E) to 1) add an Automotive Retail District; 2) expand the architectural guidelines to allow for contemporary architecture within the Automotive Retail District; and 3) add a review process and development standards within the Automotive Retail District. The properties affected by the Specific Plan Amendment are located west of Interstate 5, on the east side of Avenida Encinas, in between Palomar Airport Road to the north and Poinsettia Lane to the south, addressed as 6800 and 6830 Avenida Encinas, within Local Facilities Management Zone 22. The City Planner has determined that this project is exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to Section 15061{B)(3) (General Rule) and City of Carlsbad Municipal Code Chapter 19.04.070(A)(1)(c), minor municipal code amendments that do not involve physical modifications or lead to physical improvements beyond those typically exempt. RESOLUTION NO. 7157 STAFF RECOMMENDATION: PLANNER: Shannon Werneke Recommend Approval ENGINEER: N/ A PLANNING COMMISSION ACTION: Recommended Approval 5-1 (Commissioner Goyarts) 5. CT 15-01/PUD 15-03/SDP 15-02/HDP 15-02/HMP 16-02-CASCADA VERDE-Request for adoption of a Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program and Addendum, and the approval of a Tentative Map, Planned Development Permit, Site Development Plan, Hillside Development Permit, and Habitat Management Plan Permit to allow for the construction of a 35-unit condominium project on a 3.67 gross acre site generally located between the terminus of Altiva Place and Altisma Way, and north of Alicante Road within Local Facilities Management Zone 6. The City Planner has determined that through the implementation of the proposed Mitigated Negative Declaration, Mitigation Monitoring and Reporting Program, the proposed project mitigates the effects to a point where no significant effect on the environment would occur. MP 02-03(H)/SDP 15-13/SDP 15-19/CUP 15-05/MS 15-12-CANNON ROAD SENIOR HOUSING-Request for a reco~mendation of adoption of a Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program; a recommendation of approval for a Master Plan Amendment, Site Development Plan, Minor Site Development Plan, Conditional Use Permit and Tentative Parcel Map to allow for the subdivision of a 7.52 acre parcel into three lots, relocation of an existing RV storage lot and development of a 98-unit senior apartment project on property generally located southeast of the intersection of Cannon Road and Wind Trail Way, within the Robertson Ranch Master Plan, Planning Areas 22 and 23G, in Local Facilities Management Zone 14. The City Planner has determined that through the implementation of the proposed Mitigated Negative Declaration and Mitigation, Monitoring and Reporting Program, the proposed project avoids the effects or mitigates the effects to a point where clearly no significant effect on the environment would occur, and there is no substantial evidence in light ofthe whole record before the City that the project may have a significant effect on the environment. RESOLUTIONS NO. 7159, 7160 and 7161 STAFF RECOMMENDATION: Recommend Adoption/Recommend Approval PLANNER: Jason Goff ENGINEER: Steve Bobbett PLANNING COMMISSION ACTION: Recommended Adoption/Recommended Approvai5-0-2 (Commissioners Goyarts and Montgomery absent) Planning Commission Member Comments City Planner Comments City Attorney Comments TIME: 10:10 p.m. PLANNING COMMISSION AGENDA April 20, 2016 Page4 PLANNING COMMISSION PROCEDURE For those in the audience who are not familiar with the operation of a Planning Commission, the following is a summary ofthe procedure: For each item on the agenda, the planning staff will present a report to the Planning Commission. On items for public hearing, the audience will be asked for comment. Those wishing to speak are asked to come forward, speak into the microphone, and give their name and address for the taped record. A time limit of five minutes is allotted to each speaker. After testimony is completed, the applicant is allowed a rebuttal. The Planning Commission is anxious to hear all persons wishing to give testimony. However, it is requested that each new speaker add new information, and not repeat points which previous speakers have made. Persons not desiring to speak, but wishing to be recorded as proponents or protesters of record, may do so by submitting their name and address to the minutes clerk. Certain Planning Commission decisions are final, but may be appealed to the City Council. An appeal may be filed with the City Clerk at City Hall within 10 calendar days of the decision. The cost of filing an appeal is $1,097 plus noticing fees for all matters. If anyone wishes to question a Planning Commission decision, they may contact the Planning Division at 1635 Faraday Avenue, between the hours of 7:30 and 5:30, Monday through Thursday, and 8:00 to 5:00 on Friday.
