INCIDENTAL OUTDOOR DINING AREA PERMIT (FOR PROPERTIES LOCATED OUTSIDE OF
THE REDEVELOPMENT AREA AND OUTSIDE OF THE COMMERCIAL/VISITOR-
SERVING OVERLAY ZONE)
All applications for Incidental Outdoor Dining Areas will be reviewed and processed in accordance with
Sections 21.04.1881.1 and 21.26.013 of the Carlsbad Municipal Code and must comply with the
development standards contained in these sections.
See Section 21.26.013 of the Carlsbad Municipal Code for complete wording.
The Incidental Outdoor Dining Area:
^ 1. Must comply with A.D.A. requirements.
^•2. Must comply with all applicable A.B.C. requirements if alcoholic beverages are served.
Xw3. Can only be open/used during the hours of operation of the associated restaurant.
x>*4. Must provide adequate circulation and clearance for normal pedestrian traffic.
Must not encroach into the public right-of-way.
Must not eliminate any existing parking areas.
M. Must not interfere with vehicle or pedestrian circulation.
^ 8. Must not remove or reduce existing landscaping.
^ 9. Must not present a traffic hazard.
^MO. Must not be incompatible with outdoor dining because of the speed, volume, or nearness of vehicular
traffic.
N11. Is not included in the square footage used to calculate parking requirements.
^ 12. Shall be limited to:
\»a. a maximum of 20% of the number of indoor seats or a maximum if 20 seats whichever is
more restrictive;
^ b. a maximum of 6 tables; and
N c. a maximum of 400 square feet in area.
NOTE: EATING ESTABLISHMENTS MUST FULLY SATISFY ALL OTHERWISE APPLICABLE
PARKING REQUIREMENTS TO QUALIFY FOR INCLUSION OF AN INCIDENTAL OUTDOOR DINING
AREA. RESTAURANTS WHICH ARE UNDER PARKED ARE NOT ELIGIBLE TO PROVIDE AN
I.O.D.A.
A proposed project requiring that multiple applications be filed must be submitted prior to 3:30 p.m. A
proposed project requiring that only one application be filed must be submitted prior to 4:00 p.m.
The following materials shall be submitted for each application or for combined applications on a single
project.

NOTE: WHEN THE APPLICATION IS TENTATIVELY SCHEDULED TO BE HEARD BY THE
DECISION MAKING BODY, THE PROJECT PLANNER WILL CONTACT THE APPLICANT

1. A typewritten list of the names and addresses of all property owners within a 300 foot radius
for Administrative Variance and 600 foot radius for a Variance of subject property (including
the applicant and/or owner). The list shall include the San Diego County Assessor's parcel
number from the latest assessment rolls.
2. Two (2) separate sets of mailing labels of the property owners within a 300 foot radius for
Administrative Variance and 600 foot radius for a Variance of the subject property. The list
must be typed in all CAPITAL LETTERS, left justified, void of any punctuation. For any
address other than a single-family residence, an apartment or suite number must be included
but Apt., Suite, and Bldg. # must NOT appear in the street address line. DO NOT TYPE
ASSESSOR'S PARCEL NUMBER ON LABELS. DO NOT provide addressed envelopes -

SUBJECT: AD 04-06 - YELLOW COYOTE GRILL
Thank you for applying for Land Use Permits in the City of Carlsbad. The Planning
Department has reviewed your request for an incidental outdoor dining area permit,
application no. AD 04-06, as to its completeness for processing.
The application is incomplete, as submitted. Attached are two lists. The first list is
information which must be submitted to complete your application. This list of items must
be submitted directly to your staff planner by appointment. All list items must be
submitted simultaneously and a copy of this list must be included with your submittals,
including one (1) set of plans. No processing of your application can occur until the
application is determined to be complete. The second list is issues of concern to staff.
When all required materials are submitted the City has 30 days to make a determination of
completeness. If the application is determined to be complete, processing for a decision
on the application will be initiated. In addition, please note that you have six months from
the date the application was initially filed, July 12, 2004, to either resubmit the application
or submit the required information. Failure to resubmit the application or to submit the
materials necessary to determine your application complete shall be deemed to constitute
withdrawal of the application. If an application is withdrawn or deemed withdrawn, a new
application must be submitted.

SUBJECT: AD 04-06 - YELLOW COYOTE GRILL
The Planning Director has completed review of your application for an Incidental Outdoor
Dining Area. After careful consideration of this request, including written and verbal comments
and objections from surrounding property owners, if any, the Planning Director has determined
that the findings required for granting an Incidental Outdoor Dining Area CAN be made and,
therefore, APPROVES this request based upon the following findings and conditions:
Findings
1. That the proposed Incidental Outdoor Dining Area does not encroach into the public-
right-way, interfere with vehicle or pedestrian circulation, or eliminate any existing
parking areas, or reduce existing landscaping.
2. That the project does not present a traffic hazard and is not located in an area deemed
incompatible with outdoor dining, in the opinion of the City Engineer, because of the
speed, volume or nearness of vehicular traffic.
3. That the Planning Director has determined that the project belongs to a class of projects
that the State Secretary for Resources has found do not have a significant impact on the
environment, and it is therefore categorically exempt from the requirement for the
preparation of environmental documents pursuant to Section 15301 (Existing Facilities)
of the state CEQA Guidelines.
Conditions
1. If any of the following conditions fail to occur; or if they are, by their terms, to be
implemented and maintained over time, if any of such conditions fail to be so
implemented and maintained according to their terms, the City shall have the right to
revoke or modify all approvals herein granted; deny or further condition issuance of all
future building permits; deny, revoke or further condition all certificates of occupancy
issued under the authority of approvals herein granted; institute and prosecute litigation
to compel their compliance with said conditions or seek damages for their violation. No
vested rights are gained by Developer or a successor in interest by the City's approval
of this Administrative Incidental Outdoor Dining Area Permit.

2. The Planning Director does hereby APPROVE the INCIDENTAL OUTDOOR DINING
AREA PERMIT for the project entitled YELLOW COYOTE GRILL, Exhibit "A," dated
August 4, 2004, (on file in the Planning Department and incorporated by this reference),
subject to the conditions herein set forth. Development shall occur substantially as
shown on the approved Exhibit. Any proposed development substantially different from
this approval shall require an amendment to this approval.
3. The Developer shall comply with all applicable provisions of federal, state, and local
ordinances in effect at the time of building permit issuance.
4. The outdoor dining area must comply with the following development standards:
a. The project shall comply with the latest non-residential disabled access
requirements pursuant to Title 24 of the State Building Code.
b. All applicable requirements of the alcoholic beverage commission if alcoholic
beverages are served in the outdoor area.
5. The furniture and architecture of the outdoor dining area shall be consistent with the
existing commercial center in terms of color and design and shall be properly
maintained.
6. The Developer/Operator shall and does herby agree to indemnify, protect, defend, and
hold harmless the City of Carlsbad, its Council members, officers, employees, agents,
and representatives, from and against any and all liabilities, losses, damages, demands,
claims, and costs, including court costs and attorney's fees incurred by the City arising,
directly and indirectly, from (a) City's approval and issuance of this Incidental Outdoor
Dining Area Permit, (b) City's approval or issuance of any permit or action, whether
discretionary or non-discretionary, in connection with that use contemplated herein, and
(c) Developer/Operator's installation and operation of the facility permitted hereby,
including without limitation, and all liabilities arising from the emission by the facility of
electromagnetic fields or other energy waves or emissions.
7. Staff is authorized and directed to make, or require the Developer to make, all
corrections and modifications to the Incidental Outdoor Dining Area Permit
documents, as necessary to make them internally consistent and in conformity with the
final action on the project.
8. Approval of this request shall not excuse compliance with all applicable sections of the
Zoning Ordinance and all other applicable City ordinances in effect at time of building
permit issuance, except as otherwise specifically provided herein.
9. Any signs proposed for this development shall at a minimum be designed in
conformance with the City's Sign Ordinance and shall require review and approval of the
Planning Director prior to installation of such signs.
This decision may be appealed by you or any member of the public to the Planning Commission
with ten days of receipt of this letter. Appeals must be submitted in writing to the Planning
Commission at 1635 Faraday Avenue in Carlsbad, along with a payment of $500.00 plus

noticing costs. The filing of such appeal within such time limit shall stay the effective date of the
order of the Planning Director until such a time as a final decision on the appeal is reached. If
