Dear Ms. Fountain:
David Reynolds, the Vice President and Branch Manager for the above-noted
property, will be getting in touch with you. We are responding to your letter of
November 4, 1996, which was sent to Jeffrey Vines in San Frandsco.
I understand through Mr. Reynolds that the problem has actually run both ways
with tenants of Ms. May's property using the branch parking lot as a shortcut to
reach their Harding address. In addition, I also understand that her tenants, on
occasion, will park in the Bank's lot when their own lot is full.
In any event, we are happy to look into whatever can be done to ease the
antidpated problem. Please note that our office may be contacted should there
be other questions conceming this San Diego County branch.

Dear Mr. Vines:
Attached please find a letter from a building owner/manager, Ms. Olga May, in the
Village of Carlsbad regarding the negative impact the remodel of the bank at 840
Carlsbad Village Drive is having on her property. Ms. May owns and manages the office
building located to the east of the Union Bank of Califomia building in Carlsbad.
A copy of Ms. May's letter has been forwarded to you in an effort to obtain your
assistance in an attempt to resolve her issue with the relocation of the drive-thru lanes.
Apparently, customers leaving the drive-thru lanes are driving straight across her private
property rather than tuming left or right and traveling on the public alley.
Although the City's Engineering Department determined that the change in circulation
does not present an issue per city standards, the change h2is resulted in a problem in terms
of practical application. It is the City's hope that the bank could provide a written notice
to its customers, as well as signs, asking them to tum left or right as they leave the drive-
thru lanes and to respect the private property rights of Ms. May and her tenants. Harding
Street can be accessed by customers tuming left onto the alley and then right at Grand
Avenue. It is therefore not necessary or appropriate for bank customers to drive across
Ms. May's property to access Harding Street.
We do realize that the bank can't be responsible for its customers once they leave the
property. However, if there is anything you can do to give your customers a "courtesy
notice", Ms. May and the City would greatly appreciate your efforts. If you have any

Dear Sir:
As a result of the reconfiguration of the Bank parking lot
located at 840 Carlsbad Village Drive, our property which is just
to the east of the Bank is going to have problems.
We were aware the drive thru teller booths and lanes were being
moved closer to the main building of the Bank. What we did not
know was the lanes from these automatic tellers would face and
exit directly towards our parking lot and driveway. There is a
alley way that separates the Bank property from our property.
However, since the exit lanes face directly towards our parking
lot, motorist wishing to use Harding Street will cross the alley
way and go right through our parking lot.
Previously, there was a curb that paralleled the easterly side of
the Bank property line by the alley way. Those exiting the Bank
had to exit at the more northerly part of the property towards
Grand Avenue or exit towards Jefferson Street.
Now, there is no curb. The drive through teller lanes exit and
face directly towards our parking lot. I anticipate a tremendous
amount of Bank traffic using my parking lot to access Harding
Street. These vehicles will drive straight through our parking
lot to access Harding Street, since our parking lot is in a
direct line from the Bank exit lanes.
We are already experiencing problems with vehicles speeding
through our parking lot as if it were a public thoroughfare
connecting to Harding Street.
As a rule, tenants in our building, or their guest approach our
parking lot driving in slowly since they are preparing to park.
However, those who are using our drive way as a short cut from
and to the Bank or the alley way usually speed through our lot.
We have seen too many near accidents on our parking lot from cars
speeding through. We are not comfortable with the exit placement
of the automated tellers that funnel traffic to our driveway.
Complaints from our tenants are accelerating over the speeding
traffic coming through our lot.
We are concerned over potential accidents to our tenants and
visitors. We are also concerned over the liability exposure to
us and others. As a private property owners we are not equipped
and shouldn't be expected to maintain our parking lot as a public
thoroughfare.
We do not believe the Design Board could have been aware or
cognizant of the potential problems that would result to the
neighboring property from the present configuration of the Bank's
drive through lanes. I feel sure the Bank's design would have
been modified, requiring the flow of traffic from automatic
tellers to exit in a different location.
Since the restructuring work is done of the Bank's parking lot we
have tried to explore what options were available to us that
would divert exiting traffic from the Bank towards a direction
other than our parking lot.
We have a solution we believe would work and help alleviate the
problem. We would like to propose that traffic exiting the
Bank's automated tellers be required to turn left or right on the
alley way. Exiting traffic could be controlled by having left or
right turn signs ONLY, posted. This would prevent Bank customers
from cutting through our lot when they exit the automatic teller
lanes.
Enclosed are pictures I have taken from two different angles.
These picture shows the Bank drive through lane that faces
directly unto my parking lot. Picture # 1 and #2 were taken
behind the exit lane of the automatic tellers. The parking lot
you see in the background is our parking lot. Picture # 3 was
taken from our parking lot facing the Bank's automatic Teller
lanes. As you can see it is a straight shot from the Automatic
tellers to our property parking lot.
Your attention is appreciated. If I am directing this letter to
the wrong department, would you kindly process my concerns and
request to the proper division. I am looking forward to hearing
from you and your suggestions.^

Dear Paul:
As of this date, the Housing and Redevelopment Department has received no comments
from surrounding property owners regarding the parking lot improvements at the Union
Bank located at 840 Carlsbad Village Drive. If no comments are received by the end of
the day on June 28, 1996, the administrative permit for the subject project will be
processed for approval as of July 2,1996. The surrounding property owners will again be
notified of the decision made by the Housing and Redevelopment Director and be
provided with ten (10) calendar days to appeal the Director's decision to the Design
Review Board. If no appeals are made within the ten days, the redevelopment permit will
be issued and then you will be permitted to pull your building permits and any other
required permits.
If approved, the following conditions will be placed on the subject project:
1. The Union Bank Parking Lot Improvements shall conform to the plans submitted as
part of the application, dated and approved as of July 2, 1996, with the following
correction: A mimmum of 5' clear distance shall be provided at the ends of parking
aisles containing parking stalls located perpendicular to each other (as shown on the
redlined set of plans provided by the Engineering Department).
2. Prior to removing and replacing the driveways on Jefferson Street, the applicant shall
obtain a City right-of-way permit.
3. Prior to hauling dirt or construction materials to or from any proposed constmction
site within this project, the developer shall submit to and receive approval from the
City Engineer for the proposed haul route. The developer shall comply with all
conditions and requirements the City Engineer may impose with regards to the
hauling operation.

4. The applicant must obtain all appropriate building permits from the City of
Carlsbad's Building Department prior to initiating any demolition or constmction
activity as related to the subject project.
If all goes as planned, you will be able to pay your $220 redevelopment permit fee and
then pick up the approved administrative redevelopment permit for the Union Bank
Parking Lot Improvements from the Housing and Redevelopment Office on Friday, July
12,1996. You may concurrently process through plancheck for a building permit.
However, your building permit will not be issued until your redevelopment permit is
issued by the Housing and Redevelopment Department.
Enclosed for your review are copies of the redlined plans from the Engineering and
Building Departments. Please make any noted corrections to the plans prior to submitting
for final plancheck with the Building Department.

I have completed my review of the subject application for conformance with the Village Design
ManuaL My comments are listed below:
^ 1. The proposed parking lot will eliminate some landscaping and will replace it at different
locations. This appears to be acceptable since landscaping is not substantially reduced.
The proposed 4 drive-thru lanes which individually egress into the alley is a poor design.
The drive-thru lanes should be designed so that they exit through a single driveway similar to the
existing northerly Jefferson driveway.
^ 3. The project is categorically exempt from CEQA as a minor alteration with negligible
expansion of use, Section 15301, Class 1. I will forward the Notice of Exemption.

I have marked on the plan that the H'Cap accessible parking should have a van
accessible loading zone 8 feet wide. There was a slight conflict between the detail
and the overall plan.
It looks like they are planning a new canopy. That will require a building permit and
an electrical permit.

We have recently received correspondence from Nogle Onufer Associates Architects regarding
the Bank of California located at 840 Carlsbad Village Drive. The Bank of California is
proposing to move the location of the ATM and drive up teller area to facilitate exiting on to
the alley rather than Jefferson Street. Please review the attached proposed site plan and provide
any comments to the Housing and Redevelopment Department.
