Dear Mr. Luxton:
On your behalf, the City of Carlsbad has converted your application for an amendment to
your original Redevelopment Permit/Conditional Use Permit (88-6a) to an administrative
redevelopment permit (96-09) to allow the relocation of the freezer unit and the
constmction of a small portion of storage at the KFC location at 745 Carlsbad Village
Drive. This application for an administrative redevelopment permit was approved on
January 13, 1997.
Following approval of your application, a notice was sent to all property owners within
300 feet of the proposed project. This notice initiated a ten (10) day appeal period of the
Housing and Redevelopment Director's decision to approve the project. The City of
Carlsbad received no appeals as a result of this notice. Therefore, the approval of your
application is now complete and fmal. A copy of the approved redevelopment permit is
enclosed for your information. As noted in a previous conespondence, the conversion of
your application to an administrative permit entitles you to a refund of $588.90. On your
behalf, I have initiated the process to refund the amount shown. The refund check will be
made payable to ''KFC NationaF.
As a reminder, you must process all appropriate plans to obtain required building permits
from the Community Development Department located at 2075 Las Palmas Drive,
Carlsbad for relocation of the freezer unit and constmction of the additional storage. The
redevelopment permit is processed for land use and design purposes only; it does not
include approval of the required building permits. Building permits require a separate
application, plans and fee. You may work directly with the Carlsbad Building
Department to obtain the appropriate permits.

REFUND OF FEES FOR KFC NATIONAL - ARP 96-09
On behalf of KFC National, I would like to request a refund of application fees in the
amount of $588.90. The refund check should be made payable to "KFC National" and
forwarded to KFC National, c/o David Luxton, 2201 DuPont Drive #250, Irvine, Ca.
92715-1515.
The subject refund is due to KFC National because the application for a redevelopment
permit to relocate a freezer unit and constmct additional storage at the KFC/Taco Bell site
at 745 Carlsbad Village Drive was converted to an administrative redevelopment permit;
original RP/CUP 88-6(a) application was converted to ARP 96-09. This permit
conversion results in a fee reduction. The City collected a total of $1200 from the
applicant. The administrative permit fee and related noticing costs amount to a total of
$588.90. Therefore, KFC National is entitled to a refund of $588.90.
A copy of the approved permit is attached for your records. If you have any questions

RELOCATION
Thank you for resubmitting the materials required for your application for a Land Use
Permit in the City of Carlsbad. The Redevelopment Department, together with other
appropriate city departments, completed a second review of your Redevelopment
Permit/Coastal Development Permit Amendment application No. RP/CUP 88-6(A) and
CDP 88-06(A), as to its completeness for processing.
The application has been deemed complete for further processing. However, an
issue Still remains regarding the loading area for KFC/Taco Bell and the exterior
treatment for the freezer building. Planning Department Staff raised these issues
previously and does not believe that these issues have been adequately addressed in
the revised plans. Therefore, the following two issues remain unresolved for the
Planning Department:
1. The site plan (Sheet SI) is not drawn to scale to enable Planning Department
review. A site visit revealed that the area proposed for the freezer and vestibule
is part of an existing loading area, and there are parking spaces to the west of
this area. Although a parking space for deliveries appears to remain, there are
no dimensions on the site plan to verify that it is adequate to accommodate
delivery trucks.
2. The plans indicate that the structures are to be metal and metal siding is not
consistent with the existing structure. Since the freezer and vestibule are
attached, these accessory structures should match the existing building. The
plans must indicate how the exterior of the structures will be treated to ensure
that the match the existing building.
The above two planning issues must be resolved before staff will be able to
recommend approval of the relocation of the freezer unit. It is suggested that you
contact the Project Planner, Ann Hysong, directly at 438-1161 X 4477 to discuss the
Planning issues and how to resolve them.

For information purposes, all of the Engineering issues have been resolved on the
project based on the information you resubmitted to the Housing and Redevelopment
Office. Therefore, once you resolve the Planning issues, we will be able to
recommend approval of your project and set it for the required public hearing.
As an additional note, I recently received notice that KFC/Taco Bell is considering
improvements to their building on Carlsbad Village Drive which would result in design
changes. Representatives for KFC/Taco Bell will be meeting with me within the next
couple of weeks to discuss the proposal. The design changes may result in a need
for a redevelopment permit. If this Is so, it may be more efficient and cost effective for
KFC/Taco Bell to process one single permit for both the relocation of the freezer unit
and the building design changes or site improvements. Also, for information
purposes, we are approximately two months away from obtaining final approval from
the California Coastal Commission to issue "administrative permits" within the Village
Redevelopment Area; this would allow the freezer relocation and building
improvements to be processed in a much simpler fashion which does not require a
public hearing. It could ultimately save KFC/Taco Bell some time and frustration.
Please let me know if KFC/Taco Bell would like to withdraw its current permit and
then combine the freezer relocation project with the building design changes at a later
date under an administrative permit application.
If KFC/Taco Bell does not wish to withdraw the application for the relocation of the
freezer unit at this time, please complete any required changes to the plans per your
discussions with Ann Hysong and resubmit them to my office for final processing.

Engineering Department staff have completed a second review ofthe above referenced project
for application completeness and have determined that the application and plans submitted for
the project are now complete.
Staff has again conducted a review of the project for Engineering Issues of Concern. All
engineering issues which were previously identified have been resolved and no additional
issues have been identified. Staff, therefore, recommends approval of the project, with no
Engineering Conditions of Approval being added.

Thank you for applying for a Land Use Permit in the City of Carlsbad. The
Redevelopment Department, together with other appropriate city departments, have
reviewed your Redevelopment Permit/Coastal Development Permit Amendment
application No. RP/CUP 88-6(A) and CDP 88-06(A), as to its completeness for
processing.
The application has been deemed incomplete, as submitted. Please submit three
copies of a Preliminary Title Report, for the subject property, issued within six (6)
months of the date you submit it to the City of Carlsbad for review. Upon submission
of the required Preliminary Title Report, your application will be deemed complete for
further processing. This Preliminary Title Report must be submitted directly to the
Redevelopment Office. A copy of this letter must be submitted with the
Preliminary Title Report. No further processing of your application can occur until
the application is determined to be complete.
Once the application is determined to be complete, processing for a decision on the
application will be initiated. In addition, please note that you have six months from the
date the application was initially filed, February 9, 1996, to either resubmit the
application or submit the required information. Failure to resubmit the application or
to submit the materials necessary to determine your application complete shall be
deemed to constitute withdrawal of the application. If an application is withdrawn or
deemed withdrawn, a new application must be submitted.
Attached is a list which represents issues of concern to staff. These issues will need
to be resolved before staff will be able to recommend approval of your permit
application. These issues were primarily raised by the Engineering Department. You
may contact Mike Shirey, Associate Engineer, directly at 438-1161, extension 4388 to
discuss these issues and/or resolution in further detail.

ISSUES OF CONCERN
Engineering:
1. On the project site plan, the applicant must indicate any and all easements and
encumbrances for this property, in accordance with Schedule "B" of the
Preliminary Title Report. Also, indicate the future disposition of all easements and
encumbrances, if any. If there are no easements or encumbrances, please state
this on the site plan.
2. On the project site plan, indicate the property boundary lines which are indicated
in the Preliminary Title Report.
3. - The area where the new freezer is being proposed seems to be a loading area for
the facility. Please indicate how loading will still be accomplished. Show how a
standard truck will access this loading area without encroaching into the existing
driveway (use a CalTrans standard 407 "E" turning radius).
This issue was also raised by the Planning Department. The site plan (Sheet SI)
is not drawn to scale to enable the Planning Department to complete its review.
The concern raised is that the plan does not show how deliveries will be made to
the site. The Planning Department indicated that the plans reflect that a parking
space is provided for deliveries but there are no dimensions; therefore, the Project
Planner is unable to verify that the space is large enough to accommodate
delivery trucks.
4. Show the dimensions of the existing concrete slab, driveway, and proposed
freezer and vestibule.
5. Is the proposed vestibule intended to be a second public entrance? If so, then
adequate pedestrian circulation must be indicated via new sidewalks, landscaping,
etc.
Attached for the applicant's use for making plan revisions is a redlined check print of the
project. This check print must be returned with the revised plans to facilitate continued
staff review.
Design Issue:
1. There is one design issue related to the project. The plans indicate that the
structures are to be metal and metal siding which is not consistent with the
existing building. Since the vestibule and freezer are to be attached to the
building, the exterior walls need to be treated with materials that match the
existing building.

COMPLETENESS REVIEW AND INITIAL ISSUES STATEMENT
Engineering Department staff have completed a review of the above referenced project for
application completeness and have determined that the application and plans submitted for the
project are incomplete and unsuitable for continued review due to the following incomplete
items:
1. Please supply a Preliminary Title Report (PR) issued within six (6) months of a
formal application submittal.
2. Supply a copy of the City application to Engineering Department Land Use
Review staff indicating the property owner and applicant.
Additionally, staff has conducted a review of the project for Engineering Issues of Concern.
Engineering issues which must be resolved/addressed prior to staff making a determination on
this proposed project are as follows:

Dear Mr. Bergman:
Per my faxed memo of December 28, 1995, enclosed please find the application which was
prepared for the relocation of, and addition to, the freezer unit for the KFC/Taco Bell
located at 745 Carlsbad Village Drive in Carlsbad, Califomia. Also enclosed is a checklist of
other items which must be submitted with your application for an amendment to the
Conditional Use Permit/Redevelopment Permit for the proposed project.
As indicated in my faxed memo, an enviromnental impact assessment form must be
submitted with your application. In all likelihood, the project will be exempt from further
environmental review. However, this form must be submitted with the application and
reviewed by Plaiming Staff before an enviroimiental determination can be made for the
project. In addition, if the most recent title report does not indicate that a Public Facilities
Agreement has been recorded against the property, this agreement must be signed, notarized
and submitted with the application; a copy has been enclosed for your use, if necessary.
Unfortunately, at this time, the freezer unit relocation requires a minor redevelopment permit
which must be approved following a public hearing before the Design Review Board. In the
ftiture, we have proposed to process these type of requests with an administrative permit.
However, until this new process is approved by the California Coastal Commission, the City/
Redevelopment Agency is unable to implement it. So, a public hearing will be required for
your proposed project.
For information purposes, the fees related to your application will be approximately $1200.
It is possible that $220 of these fees will be refunded to you if it is determined that the
project is exempt from environmental review. Also, the estimated fee amount includes a
$500 deposit for noticing the public hearing for the proposed project. Once final action is
taken on the project and payments have been made as related to the noticing, any remaining
funds from the deposit will be retumed to you.

Community Development Department. Therefore, you will need to pick up the plans you
