I have been living in this home for almost a year. I used to live in the City of Encinitas in a house, which belongs to the home owner association. I had a problem parking my Boat in the driveway of my hose because of these community rules. I decided to move out because of some legal issue with my Ex-wife (divorce case), which put me under a lot of financial pressure. I moved to the existing home located in 7103 Columbine Drive in the City of Carlsbad hoping to have some peace of mind in such a peaceful neighborhood. I was under the impression that I would be able to park my Boat in the driveway of the house. I recently received a notice from the Planning Department in the City of Carlsbad in regard to a code violation involving my Boat. I have owned this Boat since 1998. This Boat is in a perfect condition and is always covered neatly and not an eyesore. I never had any complain regarding the Boat from my neighbors. I work as a Civil Engineer in the department of Transportation (Caltrans), and I understand that there should be some kind of regulations regarding the public traffic safety and driving sight view. Parking the Boat on the side of the front ~ driveway does not interfere with the visibility to or from the street, nor does it interfere with the traffic on the street or sidewalk or encroaches into the street and utility right of way (look at the attached layout and pictures). Moreover, because of the structural configuration, landscaping and the size of the Boat and trailer, parking the Boat somewhere else other than the existing location is not applicable as it shown in the attached layout and pictures. I believe I have compiled all the pertinent facts regarding my situation per your staff’s recommendation, Mr. Scott Rundinger, and Mr. Paul Godwin. I have carefully reviewed section 21.51.040 (specifically items i to iv) of the City of Carlsbad code regarding this matter. Your careful consideration is appreciated.
