Project Description This project consists of a request for an administrative variance for an over height fence. The owner of the property has constructed a fence that is over height for the established restrictions. The owner of the property received a notice of code violation from code Enforcement Officer Gene Kellog for the violation for this over height fence. In response to that letter the owner has reduced the height of the fence along the Eastern frontage and the Southern frontage to 6' and is requesting an Administrative Variance for the fence along the Western and Northern property lines. The over height fence is a 6' Cedar plank fence with an open lattice top rail that varies from 18" to 24". The topography of the property is such that the fence is along the bottom of a low area along the property line thus making the fence seem shorter then it really is. Use additional sheets if necessary. 1. Explain what special circumstances are applicable to the subject properly, including size, shape, topography, location or surroundings, whereby the strict application of the zoning ordinance deprives such property of privileges enjoyed by other property in the vicinity and under identical zoning classification: The natural contours of the land are such that to build the allowable height fence would result in a fence height that does not protect the property and its occupants and neighbors. In order to maintain the property and the landscaping ttefeaee needs to be at the property line thus creating a fence at the bottom of a dej»essiontbM creates the illusion of a short fence. Therefore, there are special circumstances that apply to the land. 2. Explain why the granting of the variance does not constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity and zone in which the subject property is located and is subject to any conditions necessary to assure compliance with this finding: If the fence were to be constructed as required by the existing code the resulting fence would be inadequate in height to perform the required task of the fence. By granting the variance there will no granting of special privileges as the subject property will then enjoy the same privileges as other properties mat do not have the unique topographical issues. The fence will conform to city ordinances where these conditions do not apply. 3. Explain why the granting of the variance does not authorize a use or activity which is not otherwise expressly authorized by the zone regulation governing the subject property: The local zoning for this property allows fences and the granting of this variance will not authorize construction of a, non-allowed use. 4. After careful consideration of the circumstances surrounding this request, the Planning Director has determined that the four findings required for granting an Administrative Variance cannot be made and therefore, denies this request based on the following findings and conditions. Findings: 1. There are not exceptional or extraordinary circumstances or conditions applicable to the property or to the intended use that do not apply generally to the other property or class of use in the same vicinity and zone because the subject property and surrounding properties meet all the zoning requirements for lot size and dimensions and the topography is not an extraordinary or unusual circumstance for this residential area. The owner's claim that the over-height fence is necessary to provide privacy for the back yard is unsupported. The neighbors to the west are approximately 10 feet lower in elevation, and the second-story windows, which face the owner's backyard, could be blocked by vegetation; therefore, alternatives exist. Also, the neighbor's windows to the north of the property are mostly blocked by tall vegetation and; therefore, the owners do not need an eight-foot high fence for privacy. In addition, the front yard fence, located at the southeast corner of the lot, does not need to be over six feet high for the owner's to be able to enjoy privacy in their back yard. 2. The requested variance is not necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone but which is denied to the property in question because the property is currently developed with a single-family home and has adequate usable (flat) areas for yards. The proposed over-height fence in the rear and side yards would provide a small amount of privacy from the neighbors to the west and north; however, this could also be accomplished with additional vegetation or moving the fence several feet towards the top of the pre-existing slope for a similar privacy effect. 3. The granting of this variance will not adversely affect the comprehensive General Plan because the property's land use designation is residential single-family. This decision may be appealed by you or any member of the public to the Planning Commission within ten days of receipt of this letter. Appeals must be submitted in writing to the Planning Commission at 1635 Faraday Avenue in Carlsbad, along with a payment of $500.00. The filing of such appeal within such time limit shall stay the effective date of the order of the Planning Director until such time as a final decision on the appeal is reached. The original complaint came from a Melany at 822-4671. She complained about the fence being over eight feet high all around the yard. When I checked the fence, it appeard to be six feet with two feet of lattice work on top. I advised Mr. Conlin that removing the lattice work would bring the fence into compliance however he decided to apply for the variance instead. I do have a couple of photos.
