JUSTIFICATION FOR VARIANCE
By law a Variance may be approved only if certain facts are found to exist. Please read these
requirements carefully and explain how the proposed project meets each of these facts. Use
additional sheets if necessary.
1. Explain why there are exceptional or extraordinary circumstances or conditions
applicable to the property or to the intended use that do not apply generally to the
other property or class of use in the same vicinity and zone:
The existing residences on Tierra Del Oro reflect the development standards
of the County of San Diego which predates city incorporation. The standards
at that time included a 10-foot public parkway next to a 10-foot private front
yard setback to provide a total of 20 feet from edge of road (Tierra Del Oro).
Current citywide standards require a 20-foot front yard setback within private
property, outside of city right of way. Granting an 8-foot front yard setback
would be consistent with the allowed/existing development in the immediate
area as several front yard encroachments that exist along Tierra Del Oro.
The request for a reduced front yard setback from 20-feet to 8-feet to allow
construction of a single family residence on the west side of Tierra del Oro
Street is further justified by the 6-foot setback permitted for the adjacent
residence to the south. The proposed reduced setback would be consistent
with the existing development in the area and on Tierra Del Oro.
2. Explain why such variance is necessary for the preservation and enjoyment of a
substantial property right possessed by other property in the same vicinity and zone
but which is denied to the property in question:
This request is necessary since several substandard (less that 20') front yard
setbacks exist for other properties in the same zone and vicinity along Tierra
Del Oro. This Administrative Variance request allows for the possession of a
property right enjoyed by other residences on Tierra Del Oro. All recent
CDP's along Tierra Del Oro have had companion Administrative Variances
approved as part of the city's entitlement actions.
3. Explain why the granting of such variance will not be materially detrimental to the
public welfare or injurious to the property or improvements in such vicinity and zone
in which the property is located:
Tierra de Oro has several existing homes with over height fences and walls
that encroach within reduced (less than 20') front yard setback areas.
Nevertheless, these features have not been found to be materially detrimental
to the public welfare or injurious to the properties located on Tierra Del Oro
and likewise, this request will not be materially detrimental or injurious to

adjacent properties either. As stated above in #2, Administrative Variances
supplement the recent CDP's issued for Tierra Del Oro residences.
4. Explain why the granting of such variance il1 not adversely affect the
comprehensive general plan:
The granting of this variance will not constitute a granting of special privileges
inconsistent with other properties on Tierra del Oro, and is consistent with the
purpose and intent of the General Plan to promote quality of life within the
city's residential districts. In addition, the granting of the requested variance is
consistent with, and implements the requirements of, the certified local
coastal program since there will not be any adverse impacts to the protection
of coastal resources or provision of shoreline access.
To reject this Administrative Variance would be inconsistent with the General
Plan. Streets that contain multiple approved variances in the city (like Tierra
Del Oro and Ocean Street) need to continue issuing variance approvals to
retain zoning/development standard equity over time. Otherwise, revised
development standards established by the city need to be implemented that
make sense for the subject area(s).
