On Sheet 1, please make the following corrections/additions: a. Add the Zoning (R-1) and General Plan Land Use designation (RLM). b. Add the setbacks required/shown as follows: Front 20'/22'6", north side 10'/2', south side 10'/23'6", Rear 20'/29'4". c. Add the top of slope contour line on the north side of the property. d. It is not clear if the setbacks are measured to the post of the proposed patio cover or to the overhang. Please add clear dimensions to the posts and also dimension the overhang. e. Verify that the chimney flue is needed since the fireplace detail calls for a vent free fireplace. f. Correct all street names to read "Viejo Castilla Way". 2. The property sits on top of a hillside greater than 15' in height. Carlsbad Municipal Code (CMC) Section 21.95.120(1)(1) states that main and accessory buildings "shall be setback so that the building does not intrude into one foot vertical to .7 foot horizontal imaginary diagonal plane that is measured from the edge of slope to the building. For all buildings which are subject to this slope edge building setback standard, a profile of the diagonal plane shall be submitted with all other development application requirements." CMC Section 21.95.120(1)(2) states that the above referenced requirement does not apply to downhill slopes which are located on the side yards of residential lots. However, CMC Section 21.46.120(7)(A) states that "The city planner shall find that approval of the variance will not cause any adverse physical or visual impacts on adjacent properties. " Since this north side yard acts similar to a rear yard, it has been determined that this patio shall comply with the top of slope setback as it will cause visual impacts on the adjacent property to the east. If the property owner to the east submits a letter of support for the patio cover not meeting the top of slope setback, the City Planner will take that into consideration when making the determination. Otherwise, the patio cover needs to be redesigned to meet the 1' /.7' top of slope setback ratio. 3. Please open up the west elevation of the patio cover so that it opens up the patio. A solid wall along the west elevation is not supported. 4. Please label the existing exterior wall on the east and west elevations.
