• • JUSTIFICATION FOR RV ADMINISTRATIVE VARIANCE
An RV Administrative Variance may be approved if the City Planner determines that access to the
side or rear yard cannot be provided. In order to approve the request, the City Planner shall be
required to make the following findings. Please read these carefully and explain how the proposed
project meets each of them. Use additional sheets if necessary.
1. Parking in or acce~o the side or rear yard would require one of more of the following: a)
extensive grading,~structural alteration to the existing residence, or c) the removal of
significant or unique landscaping. A fence shall not be deemed to prevent access to the
side or rear yard.
2. Parking of the recreational vehicle in the front yard would not interfere with visibility to or
from any street.
3. Parking of the recreational vehicle in the front yard would not interfere with traffic on the
~et or sidewalk nor encroach into the street and util~ty right-of-way.

that the State Secretary for Resources has found do not have a significant impact on the environment,

variance, of the state CEQA Guidelines.

I am here to ask you not to approve the findings the Planning Department has offered.

"The parking in or access to the side or rear yard would require structural alteration to the existing
residence or will require the removal of significant or unique landscaping. "
RESPONSE: Please see Exhibit 1.
There is no significant structural alteration required. The only modification needed is to round
off or remove a small section of the overhang at the southeast corner of the garage. Since the
garage roofline rises quickly the section removed from the overhang would be a maximum of one
foot wide and 4 feet long.
There is no significant or unique landscape. There is a large bush that appears to be 3-4 feet wide
by approximately 6 feet tall that runs along most of the east side property line. It appears to be
shared with the neighbor.
"The largest side yard (east side) is 9 feet and I inch wide including the roof eaves which extend I foot
into the side yard. Specifically there would only be a Clearance of3.5 inches. A structural alteration
involving the removal of a portion of the roof eave in order to have more room to potentially fit the
RVwithin the side yard."
RESPONSE: The side setback for this site is 10 feet. The overhang ofthe eave is approximately 1
foot. The overhang is only an issue for a 1 foot wide by 4 feet long area. Please see Exhibit 2
which was provided by the applicant.
"Furthermore existing utility boxes located directly in front of the eastern side yard restrict
maneuverability of the RV on this side of the property"
RESPONSE: These boxes are near or abutting the sidewalk and present no significant restriction.

• • RESPONSE:
The parking of the RV on the driveway creates a dangerous situation for adults and children
walking westbound on the sidewalk. When the Ross's are backing out one their other vehicles
from the garage the RV blocks their view. It is impossible for them to see walkers or runners
westbound.

This is to advise you that we are appealing the approval of AV 13-08 dated November 21, 2013.
We ask that this appeal go directly to the City Council for review and change to the Code that
you based your decision upon. The approval of this variance invites more people to request a
variance to park their RV's in their front yard setback in violation of their own CC&R's.
There is something very wrong when the City of Carlsbad knowingly gives a resident a variance
to park their RV in their front yard setback, when the City is aware that the resident's more
restrictive CC&R's do not allow it. The City of Carlsbad's position is that they have to enforce
this code even though another Carlsbad Code states that our CC&R' s, which are more restrictive,
supersede the City code.
1. The property in question has CC&R's in effect from March 5, 1973 to the present. They
state "No Living trailer, house car or "campster", boat or boat trailer shall be parked on
any road or building site either temporarily or permanently, or shall any such motor
vehicle not capable of being operated be parked for longer than forty-eight hours ( 48)
outside of a garage on any street, lot or building site". Page 997 #6.
2. The City of Carlsbad has ordinance 21.44.060 Off-street parking-Residential zones.
Table E "Recreational vehicles, boats and trailers includes: "The Provisions listed in this
section are not intended to supersede more restrictive homeowner provisions contained in
approved conditions, covenants and restrictions ( CC&Rs ). If the provisions of any such
CC&R's are less restrictive than the ordinance codified in this section then the provisions
contained herein shall apply".
We ask that our appeal include all written and emailed information and correspondence received
by the Planning Department from all interested parties. Please provide copies of all documents
the Planning Department has received from Mr. and Mrs. Ross concerning this issue. Please
provide a copy of the mailing list used to notifY the impacted neighbors.
We are concerned about the effects this approval will have on our neighborhood's health, safety
and quality oflife. ·

The City Planner has completed a review of your application for an Administrative Variance, AV 13-08, to
allow the parking of an 8.5 foot wide by 23 foot long recreational vehicle in the required front yard
setback located at 3024 Garboso Street. After careful consideration of the circumstances surrounding
this request, the City Planner has determined that the four findings required for granting an
Administrative Variance can be made and therefore, APPROVES this request based on the following
findings and conditions.
Findings:
1. That parking in or access to the side or rear yard will require structural alteration to the existing
residence or will require the removal of significant or unique landscaping in that the largest side
yard (east side) is 9 feet (') and 1 inch (") wide including the roof eaves which extend 1' into
the side yard, making it very difficult to locate the 8'6" wide recreational vehicle (RV) within
the 9'1# wide side yard. Specifically, there would only be a clearance of 3.5" (9'1"-8'6" = 7")
on each side of the RV. A structural alteration involving the removal of a portion of the roof
eave would be required in order to have more room to potentially fit the RV within the side
yard. Furthermore, existing utility boxes located directly in front of the eastern side yard
restrict maneuverability of the RV on this side of the property.
2. That parking of the recreational vehicle in or access to the side or rear yard would not require
extensive grading to the side or rear yard. However, it is very difficult to fit the 8'6" wide RV
within the side yard given the limited 9'1" wide space between the existing structures and the
property line as described above.
3. Parking of the recreational vehicle in the front yard will not interfere with visibility to or from
Garboso Street in that adequate sight distance is provided and the lot in question is an interior
lot located on a relatively straight portion of Garboso Street which affords appropriate sight
distance.
4. That the recreational vehicle will not interfere with traffic on the street or sidewalk or encroach
into the street and utility right-of-way in that the RV does not encroach into the public right-of-
way since the recreational vehicle is 23 feet in length and the available parking area in the
driveway is approximately 26 feet outside of the public right-of-way.

Conditions:
1. The recreational vehicle is not considered a habitable structure when parked on the property
and shall not be used in such a manor.
2. All "slide-outs", "pop-ups", awnings or similar features shall not be deployed and shall be kept
in the "in" or "down" position in order to minimize the mass of the recreational vehicle.
3: Approval is granted for AV 13-08 as shown on Exhibit "A", dated November 20, 2013, on file in
the Planning Division and incorporated herein by reference. Development shall occur
substantially as shown unless otherwise notes in these conditions.
This decision may be appealed by you or any member of the public to the Planning Commission within
ten (10} days of receipt of this letter. Appeals must be submitted in writing to the Planning Commission
at 1635 Faraday Avenue in Carlsbad, along with a payment of $651.00 pius noticing fees. The filing of
such appeal within such time limit shall stay the effective date of the order of the City Planner until such

APPLICABILITY/PROCESS DETERMINATION AND TARGET DECISION DATE
CEQA Determination:
This is to advise you that after reviewing the application for the project referenced above, the City has
determined that the following environmental review process (pursuant to CEQA) will be required for the
project:
The project is exempt from the provisions of CEQA, pursuant to CEQA Categorical Exemption for Minor
Alterations in Land Use Limitations -State CEQA Guidelines Section 15305. No environmental review is
required for the project.
A Notice of Exemption will be filed after approval of the project with the San Diego County Clerk's Office
which involves a filing fee. Please submit a check to the project planner in the amount of $50.00 made out
to the San Diego County Clerk. The check should be submitted approximately one week prior to the City
Planner decision date.
Target Decision Date:
In the interest of expeditiously processing your application consistent with the State Permit Streamlining Act
(California Government Code Section 65950), an administrative decision to approve or deny the project
should be determined by November 22, 2013.
Therefore, in the interest of achieving that decision date/hearing date, all remaining project issues must be
addressed by November 8, 2013. If all project issues are not resolved by the date listed above, you may
formally request a one-time 90 day application extension. Otherwise, you will need to withdraw the
application.

A map to scale not less than 1" = 200' showing each lot within a 300 foot radius of exterior
boundaries of the subject property. Each of these lots shall be consecutively numbered and
