An RV Administrative Variance applicatton is required whenever an applicant desires to park a recreational vehicle in a front yard setback. An RV variance may be approved as an administrative act by the City Planner. - Submitting your application: Submit your application, plans and fees at the public counter of the Planning Division at 1635 Faraday Avenue, (760) 602-4610. Your application will not be accepted unless all ofthe required materials are submitted. See Fee Schedule for processing fee amounts. Appeal procedures for RV Administrative Variances: When the RV Administrative Variance is approved or denied by the City Planner, you may appeal this decision to the Planning Commission. You must draft a letter requesting the appeal, submit it to the City Planner, and pay the required fee within ten (10) calendar days from the date of the decision. If your appeal of the City Planner's decision on the RV Administrative Variance is denied by the Planning Commission, you may appeal the Planning Commission's decision to the City Council. You must submit a letter requesting the appeal and pay the required fee to the City Clerk within ten (10) calendar days from the date of the Planning Commission decision. In order to approve the request, the City Planner shall be required to make the foiiowing findings. Please read these carefully and explain how the proposed project meets each of them. After careful consideration ofthe circumstances surrounding this request, the City Planner has determined that the four findings required for granting an Administrative Variance can be made and therefore, APPROVES this request based on the following findings and conditions. Findings: 1. That parking in or access to the side or rear yard will require structural alteration to the existing residence or will require the removal of significant or unique landscaping in that the west side yard is nine (9) feet five (5) inches wide and contains a three (3) foot tail retaining wall built with CMU blocks that encroaches 3 feet and 5 inches into the sideyard. The remaining six (6) foot opening will not accommodate the eight (8) foot two (2) inch wide recreational vehicle. The east side yard is 16 feet wide, however, several palm trees would have to be removed and a curb cut and grading would be required to access this area. 2. That parking of the recreational vehicle in or access to the side or rear would require extensive grading to the side or rear yard as the east side yard has a significant slope that would need to be cut and a retaining wall installed to stabilize the cut. The west yard would require minor grading to smooth out the shallow three (3) foot five (5) inch slope to access the side yard. 3. Parking of the recreational vehicle in the front yard will not interfere with visibility to or from Piragua Street in that adequate site distance is provided and the subject lot is an interior lot. 4. That the recreational vehicle will not interfere with traffic on the street or sidewalk or encroach into the street and utility right-of-way in that the recreational vehicle would not encroach into the public right-of-way since the length of the recreational vehicle is 21 feet and the driveway length is 27 feet 6 inches. Conditions: 1. The recreational vehicle Is not considered a habitable structure when parked on the property and shall not be used in such a manor. All "slide-outs," "pop-ups" or similar features shall not be deployed and shall be kept in the "in" or "down" position In order to minimize the mass ofthe recreational vehicle. 3. Approval is granted for AV 13-09 as shown on Exhibit "A," dated November 20, 2013, on file in the Planning Division and incorporated herein by reference. Development shall occur substantially as shown unless otherwise noted in these conditions. This decision may be appealed by you or any member of the public to the Planning Commission within ten days of receipt of this letter. Appeals must be submitted in writing to the Planning Commission at 1635 Faraday Avenue in Carlsbad, along with a payment of $651.00. The filing of such appeal within such time limit shall stay the effective date of the order of the City Planner until such time as a final decision on the appeal is reached. I have invested in this neightjorhood for almost 30 years and do not want the value to be lessened by recreational toys being parked either on the street or in drive ways. Already there is a boat that is parked in a driveway across the street from 3320 Piragua St and am sure that is illegal as well.
