JUSTIFICATION FOR VARIANCE
By law a Variance may be approved only if certain facts are found to exist. Please read these requirements
carefully and explain how the proposed project meets each of these facts. Use additional sheets if necessary.
1. Explain what special circumstances are applicable to the subject property, including size, shape, topography,
location or surroundings, whereby the strict application of the zoning ordinance deprives such property of
privileges enjoyed by other property in the vicinity and under identical zoning classification:
The special circumstances for the single story structures are due to the maximum allowable
coverage limitations of 40% ofthe gross lot area and the lot size that is necessary to
accommodate a single story unit. The Variance request is to allow 50% ofthe Net Lot Area.
2. Explain why the granting of the variance does not constitute a grant of special privileges inconsistent with the
limitations upon other properties in the vicinity and zone in which the subject property is located and is subject
to any conditions necessary to assure compliance with this finding:
Granting a variance for the single story units to allow a patio cover/deck does not constitute
a special privilege that all other 2 story units do not already have. The coverage allowance
will be similar to other approved projects within the La Costa Master Plan and surrounding
areas.
3. Explain why the granting of the variance does not authorize a use or activity which is not othenwise expressly
authorized by the zone regulation governing the subject property:
Granting a variance for the lots with single story structures plotted will only allow for a patio
cover/deck of up to a maximum square footage as allowed as a percentage of the net lot
area (50%). This use is an allowed use within the R-1 Residential zone.
4. Explain why the granting of the variance is consistent with the general purpose and intent of the General Plan
and any applicable specific or Master Plans:
Granting a variance for the lots with single story structures plotted will only allow for a patio
cover/deck of up to a maximum square footage as allowed as a percentage ofthe net lot
area (50%). This use is an allowed use within the RLM General Plan Land Use category.
5. If located within the coastal zone, explain why the variance is consistent with and implements the
requirements of the certified local coastal program and that the variance does not reduce or in any manner
adversely affect the protection of coastal resources.

NOTICE OF REQUEST FOR ADMINISTRATIVE VARIANCE
Notice is hereby given that an administrative variance has been applied for to allow lots with single story
homes in the Arterro development (La Costa Town Square residential) to have up to 50% lot coverage in
orderto accommodate patio covers. Single story homes have a larger "footprint" than two-story homes,
which restricts, and in some cases prohibits the homeowner from being able to construct a patio cover.
The permitted lot coverage would be 40% without approval of an administrative variance. The lots that
are part ofthis administrative variance request are indicated with an asterisk on the attached site plan.
If you have any objections to the granting of this variance or wish to have an administrative hearing to
discuss the requested variance, please notify the Planning Division, 1635 Faraday Avenue, Carlsbad,
California 92008, in writing within 10 calendar days of the date of this notice. If you have any questions,
