Subject: Administrative Variance 84-2 - Request to reduce a side yard setback from nine feet to eight feet six inches on property located at 6542 Avenida Del Paraiso Street .
The Land Use Planning office has completed a review of your application for an Administrative Variance at 6542 Avenida Del Paraiso Street.
After careful consideration of the circumstances surrounding this request, the Land Use Planning Manager has determined that the four findings required for granting an Administrative Variance
can be made and, therefore, approves this request based on the
following findings and conditions:
Findings:
There are exceptional or extraordinary circumstances or
conditions applicable to this property that do not generally apply to other property in the same vicinity and zone, as when property was originally measured the setback was
measured wrong. When re-measured it was found to be within
the required setback, thus the unusual circumstance.
That the requested variance is necessary for the
preservation of a substantial property right possessed by other property in the same vicinity. Because of this error, the applicant will not be able to construct his single family
home .
The granting of this variance will not be materially
detrimental to the general public because the amount of intrusion into the setback is not significant enough to
notice without an actual measurement.
The granting of this variance will not affect the general
plan since no increase in density is being requested.

Conditions:
1) Approval is granted for AV 84-2, as shown on Exhibit "A",
dated September 26, 1984, incorporated by reference and on
file in the Land Use Planning Office. Development shall occur substantially as shown unless otherwise noted in these conditions.

9) This approval shall become null and void if building permits are not issued for this project within one year from the date of project approval .
