King 41 56 Highland Drive Carlsbad, CA 92008 RE: ADMINISTRATIVE VARIANCE Staff has reviewed your application for an administrative variance and after careful consideration has determined that your request cannot be supported. The information provided on your site plan has been incorrect/incomplete from the first submittal. At the first plan check, the submitted plans did not contain lot dimensions and you were asked to provide a sideyard setback of 10% of the lot width. You indicated this would be covered by a 8' - 9' setback, which you wrote on the plans. After the project was red tagged by the Building Department, I spoke with Marty Orenyak, the Building and Planning Director. I explained to him that you would need to obtain an administrative variance to complete the structure according to your plans. This would mean an encroachment into the setback of 1 ' - 2'. The last set of plans submitted to the Land Use Planning Office indicate a sideyard setback of 2.5', 3-25', and 5.5'. This is a significant difference from the distance of 8' - 9' which you originally indicated. Another issue staff has considered is the fact that the Engineering Department feels the present slope is unstable and unable to support the structure. In addition, although the present right-of-way on Hillside Drive is 50', the Engineering Department has indicated the street will eventually be widened to a 60' width. This would preclude the construction of the garage at the requested location. c February 27, 1985 Page Two For these reasons, staff cannot support your request for an administrative variance. There are two options available to you. One is to go ahead with a denial and then appeal to the Planning Commission for a decision. The other option is to submit a request for a refund. Staff regrets any inconvenience this may cause, however, this situation would not have occured if your initial application had contained accurate information.
