Dear Neighbor,
On April 20th we're going to a special meeting to consider the
matter of assessments for homeowners who have fenced patio areas,
I've asked an attorney who is expert in real estate law to
examine our CC&Rs and advise me whether the Board of Governors
may authorize homeowners to fence off common areas into which their
livingroons open .
Harry Haubert, the attorney, came here to examine our fences,
then left to prepare his analysis. There is a copy enclosed. Notice8
both the Board and the homeowner are separately liable when common
areas are partitioned off.
I urge you to study Mr. Haubert's letter and get a lawyer's
advice so that we can discuss it at the Saturday meeting and
thereafter if it is necessary.
