We are responding to your letter of January IO, 1986
reqardinq the application for a variance made by Ms. M. Eeilbey
to approve the encroachment of a 6 foot high fence into the 2C)
foot setback on the front yard at 252 Juniper Avenue. We urge
that the planning commission not grant this variance.
We call your attention to a suit we brought before the
Superior Court on July 15, 1985 in Complaint of encroachment of
the common area 0.f the Casa de la Playa by the 6 foot fencing
that Ms. Eeilbey and others have erected throughout the Casa de la Playa in violation of the Declaration of Restrictions that
govern the affairs af this Condominium. The suit has not yet
come to trial.
