Gentlemen:
Re: Administrative Variance No. 85-8 Mrs. Beilby
The Land Use Planning Manager denied the request of
our client, Marichu Beilby for a variance for her six foot
fence in the front yard set back area.
This letter constitutes her appeal to the Planning
Commission of the order of denial by the Land Use Planning
Manager.
We are aware that the Carlsbad Code section states
that an appeal must be submitted within 10 days from the
rendering of the opinion, however, in this case, although
the denial was dated November 19, 1985, Mrs. Beilby received
the denial on December 2, 1985 and neither Mr. Rudin or the
undersigned, agents of Mrs. Beilby,were furnished copies of the denial. Accordingly, it is requested that the time per- iod be waived in this case.
