SUBJECT: Administrative Variance No. 86-11 - Request to reduce
a side yard setback from six feet to four feet on
property located at 7721 Calina Way.
The Planning Director has completed a review of your application
for an administrative variance at 7721 Calina Way. After careful
consideration of the circumstances surrounding this request, the
Planning Director has determined that the four findings required
for granting an administrative variance can be made and,
therefore, this request based on the following findings
and conditions.
Findings:
1. There are exceptional or extraordinary circumstances or
conditions applicable to the property or to the intended use
that do not apply generally to the other property or class of
use in the same vicinity and zone, because when property was
originally measured the setback was measured wrong. The
plans were approved by the City of Carlsbad and final
inspection was approved.
2. The requested variance is necessary €or the preservation and
enjoyment of a substantial property right possessed by other
property in the same vicinity and zone but which is denied to
the property in question because the house is built and
occupied. It is because the contractor used existing fence
lines as referral points that there is encroachment into the
required setback.

3. The granting of this variance will not be materially
detrimental to the public welfare or injurious to the
property or improvements in the vicinty and zone in which the
property is located because the amount of intrusion into the
setback is not significant enough to notice without an actual
measurement.
4. The granting of this variance will not adversely affect the
comprehensive General Plan because no increase in density is
being requested.
Conditions:
1. Approval is granted for AV 86-11, as shown on Exhibit "A",
dated September 22, 1986, on file in the Planning Department
and incorporated herein by reference.
2. The fence on the south side of the house is to be relocated
to the property line within 30 days from the date of this
approval.
you have the right to appeal this decision to the Planning
Commission within ten days of receipt of this letter. If YOU
