Dear Ms. James: The Planning Director has completed a review of your application for an administrative variance at 3931 Garfield Street. After careful consideration of the circumstances surrounding this request, the Planning Director has determined that the four findings required by State law for granting an administrative variance can be made and, therefore, approves this request based on the following findings and conditions: Findings: 1.- There are exceptional or extraordinary circumstances applicable to the property that do not apply generally to other property in the same vicinity and zone. The existing structure does not allow room for parking outside of the required setback area. 2. The requested variance is necessary for the preserva- tion and enjoyment of a substantial property right possessed by other property in the same vicinity and zone but which is denied to the property in question. The substantial property right enjoyed by the property is the right to’ a residential dwelling unit and its expansion within reasonable setbacks. Granting of the variance will allow this to happen. 3. The granting of this variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and zone in which the property is located because it is the existing situation in the neighborhood. The homes originally constructed along Garfield were one car garage units. Many of these still exist. Joyce games October 30, 1987 Page Two 4.
