Dear Mr. Banks: Staff has reviewed your proposal to reconstruct your retaining wall by. splitting it and creating a bi-level wall in an attempt to conform with the City's Zoning Ordinance. This proposal does not meet City standards and cannot be supported by staff. The seven foot height of the wall at the rear property line exceeds the City's six foot height limitation and would require an administrative variance. Once again, staff feels that the most acceptable option is that which was agreed upon January 7th of this year. This requires you to lower the crib wall to the height of your neighbor's fence (to the northeast), which would be approximately four to five feet. A 2: 1 slope could then be filled to the top of the wall, thereby possibly pushing your fence to the top of the 2: 1 slope and out of the setback. (See attached sketch. ) Also, the 2 : 1 slope should be planted and irrigated immediately. As you were previously notified, this matter was to be taken care of by May 13, 1988, or be referred to the City Attorney's office. This time limit will now be extended to May 27, 1988.
