HomeMy WebLinkAboutAV 87-07; Van Houten Dale & Renee Wall; Administrative Variance (AV)PLANNING DEPARTMENT I - 2075 LAS PALMAS DRIVE CARLSBAD, CALIFORNIA 92009-4859 (619) 438-1161 January 10, 1988 Dale and Renee Van Houten 2475 Jefferson Street, Suite 303 Carlsbad, CA 92008 SUBJECT: ADMINISTRATIVE VARIANCE NO. 87-7 - REQUEST TO PLACE A 5' STUCCO WALL 5' FROM THE REAR PROPERTY LINE ON A THROUGH LOT Dear Mr. & Mrs. Van Houten: The Planning Director has completed a review of your application for an administrative variance at APN 207-412-16, located between Telescope Avenue and Hillside Drive. After careful consideration of the circumstances surrounding this request, the Planning Director has determined that the four findings required for granting an administrative variance can be made and, therefore, approves this request based on the following findings and conditions. Findinqs: 1. There are exceptional or extraordinary circumstances or conditions applicable to the property or to the intended use that do not apply generally to the other property or class of use in the same vicinity and zone. The subject site is exceptional because it is a through lot which consists of a very steeply sloping, unusable frontyard and a small usable rear yard. The rear yard is located at the same elevation as the street. Without a fence at the requested location, the residents would have no privacy because all yard areas are extremely visible. The requested variance is necessary for the preservation and enjoyment of a substantial property right possessed by other properties in the same vicinity and zone but which is denied to the property in question, because other homeowners in the neighborhood have the opportunity to have private outdoor areas somewhere on their lot while this property owner does not. 3. The granting of this variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and zone in which the property is located because the properties across the street are located at an elevation 16' higher than the subject site and will not be adversely impacted by the proposed fence. Landscaping is proposed to soften the appearance of the fence. 4. The granting of this variance will not adversely affect the comprehensive General Plan because no use change is being proposed and the variance procedure is an implementing tool of the General Plan. Conditions: 1. Approval is granted for AV #87-7, as shown on Exhibit rvA*l, dated January 10, 1988, on file in the Planning Department and incorporated herein by reference.
