Holzmil ler Planning Director City of Carlsbad 2075 Las Palmas Dr. Carl sbad, CA 92009-4859 RE: Administrative Variance No. 88-5 Retaining wall at 7219 El Fuerte Street Dear Mr. Holzmiller, I received your letter dated May 17, 1988 denying the request for variance identified above on May 19, 1988. I wish to appeal that decision to the Planning Commission. Please treat this letter as official notification of the appeal, but if you need me to comply with a particular format please notify me and I will comply with your request. I 'd appreciate it if you could describe the appeal process. Is it necessary or useful for us to supply more information? Are we able to make a presentation to the Planning Commission? What is the length of time for the appeal process? I will appreciate any other information you can provide that will help make this application more successful the second time around. Mr. Kyle and I believe that the request does satisfy the zoning code requirements for a variance because of the erosion problem we described in the application. The question of visual aesthetics is difficult to answer. Since the adjacent property is vacant, it is difficult to know how the wall will affect the residence that will be built there eventually. Mr. Kyle is willing to do anything reasonable to improve the aesthetic appeal of the wall short of tearing down the wall. We are open to suggestions.
