BY , Pa+tner . c JUSTIFICATION FOR VARIANCE By law a Variance may be approved only if certain facts are found to exist. Please read these requirements carefully and explain how the proposed project meets each of these facts. Use additional sheets if necessary. 1) Explain why there are exceptional or extraordinary circumstances or conditions applicable to the property or to the intended use that do not apply generally to the other property or class of use in the same vicinity and zone: This condo. housing project was built in 1973 and was one of the first such projects il the area. It is located at the end of a cul-de-sac and is secluded from the main fluw of mtor/pedestrian traffic. Subsequent condo. projects have been erected that include in their design the security and privacy that will be provided by the wall we propose. For the most part, the subject property sets toward the rear of the site leaving the area between building and front prop. line open for parking & planting. The wall/fence The wall/fence will also serve to shield the view of the parking area from neighbors (cont . ) 2) Explain why such variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone but which is denied to the property in question: The wall/fence along with the electronically-controlled gate will provide needed sec- urity to the owners of the individual units; mers that are largely single and/or reaching retirement years. The wall/fence not only protects the individual safety of tl. Owners but also safeguards their vehicles from possible theft or vandalism. These same safeguards have been variously provided for in neighboring condo. developments which leaves "La Costa Cay" in a mre uniquely available and vulnerable situation. 3) Explain why the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located: The erection of the proposed walllfence will occur in conformance with other structures on adjacent & neighboring property. The location of the project, at the end of a cul-de sac, precludes the possibility of the wall blocking the view of drivers. The wall/fence will also contribute to an already-existing security conciousness in the neiqhborhocd. ~~ ~ ~~ ~~ ~~ ~~ ~~ ~~~ ~~ tribute taward increasing everyone's property values. 4) Explain why the granting of such variance will not adversely affect the comprehensive plan : The proposed wall/fence is for an existing 34 unit development and would appear to have Very little, if any, effect on the comprehensive plan. Walls of a similar nature are comnly found larger developments throughout the comity and, in some cases, are requested by the City as a prerequisite for development. n #1 cont. : and the street. Along Navarra there are several multi-family projects that have buildings, walls and other improvements built at the front setback line or en- croaching beyond. We feel the wall/fence we propose would fit-in with a pattern already established in the neighborhood and would not aesthetically protrude be- yond existing wall lines on adjacent properties. a
