HomeMy WebLinkAboutAV 89-07; Redding Wall; Administrative Variance (AV) (9).- 2236 Janis Way Carlsbad, CA 92008 August 13, 1989 Mr. Jeff Gibson Planning Department City of Carlsbad 2075 Las Palmas Drive Carlsbad, CA 92009 SUBJECT: AV 89-7, M and V Redding Dear Mr. Gibson: This letter is to further document my telephone call to you on August 8, 1989 voicing my objection to the block wall at 2246 Janis Way, Lot 26 Ezan. I live west of the block wall at 2236 Janis Way. A contractual agreement was drawn up between us and the contracter due to the sidewall being a shared property and monetary expense. According to the agreement of our contract the wall was not to extend farther than the front of our garage. However, the Redding family felt they did not have to disclose any information when theycontinuously "changed their mindtt. A joint agreement monetarily and contractually should also include joint decisions to ttourll portion of the block wall. I am recognized by the State of California to being permanently disabled. The extent of my disabilities is not the issue. However, the medical fact that I have no peripheral vision in my right eye presents serious problems due to the massive obstruction of vision created by the block wall on the side and in the front of the Redding property. I do not agree to allow a hazardous condtion hinder my already limited field of vision. I support the wall that exists on our property extending past our garage be torn down. This is because of the above stated reasons and also because it is in violation of Carlsbad city ordinances. It was the Ezan developer that filed the petition to the walls noncompliance to city code. We only want to follow code accordingly by the law. Please take this in to serious consideration. If it is not complied with according to our wishes we are willing to tear down the joint wall and have it moved entirely to the Redding property where they can do what ever they chose, but it will also be at their expense.
