JUSTIFICATION FOR VARIANCE
1) Explanation of exceptional or extraordinary circumstances.
Our lot #34, is on a short stretch of Chestnut that is substantially steep. The lot was originally graded as a Tri-level, leaving only a small portion of the front
yard usable. Constructing the wall and leveling out the
grounds, has given us a yard equal to the rest of the
neighborhood.
2) Explanation of preservation and enjoyment of propery right.
Chestnut Avenue is one of a few access roads that service hundreds of residences and our location being on a
steep downgrade, vehicles travel at an extremely high rate
of speed; we took a time count of traffic in a minimal 10
minute period 38 Cars traveled past our home. As noted on the Site Plans being submitted, the height of the wall on
the inside part of the property to an average height of 40". My wife and I felt this was a safe height and would help
to protect our children from a runnaway object, or from the danger of being accidentally hit by a passing car. I am submitting photographs and addresses of properties in
a similar situation. The wall also acts as a sound barrier from this excessive car noise.
3) Granting the variance will not be detrimental to public.
The granting of this variance will insure the safety and well being of my family and any future homeowner.
It will give joy for and security for many years to come.
4) Granting this variance vi11 not adversely affect the plan.
The granting of this variance will insure the beauty of this neighborhood as it is presented in estate manner
and enhances the city of Carlsbad.

Completed Justification For Variance Form.
Four (4) copies of site plan (24" x 36'' folded to 84" x 11") shall include the following information: - Name and address of applicant, engineer and/or architect, etc.
- Dimensioned locations of:

access, both pedestrian and vehicular, showing service areas
and points of ingress and egress offstreet parking and loading
areas showing location, number and typical dimension of spaces, and wheel stops - distances between buildings and/or structures - building setbacks (front, rear and sides) - location, height, and materials of walls and fences - location of freestanding signs - a summary table indicating the following information (if applicable
to the variance):
site acreage
existing zone and land use proposed land use total building coverage
building square footage
percent landscaping
number of parking spaces
square footage of open/recreational space (if applicable) cubic footage of storage space (if applicable).
Four (4) copies of building elevations and floor plans (24" x 36" folded to 83'' x 11") shall include the following information: - location and size of storage areas - all buildings, structures, walls and/or fences, signs and exterior
lights.
One (1) copy of 84" x 11" location map (suggested scale 200" - vicinity
maps on the site plan are not acceptable).
Disclosure Statement.
Property Owners' List and Addressed Labels - A typewritten list of the names and addresses of all property owners and occupants within a 300 foot radius of subject property (including the applicant and/or owner). The list shall include the San Diego
County Assessor's parcel number from the latest assessment rolls. - Two (2) separate sets of mailing labels of the property owners and
occupants within a 300 foot radius of subject property. For any
address other than single family residence, apartment or suite number
must be included. DO NOT TYPE ASSESSOR'S PARCEL NUMBER
ON LABELS. Applicant must submit separate check to cover cost of
postage.

A map to scale not less than 1" = 200' showing each lot within 300 feet
of the exterior boundaries of the subject property. Each of these lots shall be consecutively numbered and correspond with the property owner's list. The scale of the map may be reduced to a scale acceptable to the Planning Director if the required scale is impractical.

APPLICATION REQUIREMENTS FOR
A variance appl ication is required whenever an appl icant desires a variance from the requirements of the zoning codes. A variance may be approved as an administrative act by either the Planning Commission or the Planning Director. A variance which can be approved by the Planning Director is known as an Administrative variance and is limited
to the following:
1. Modification of distance of area regulations, provided such modification does
not exceed seventy-five percent of required front, side or rear yards nor exceed ten percent of maximum lot coverage regulations; 2. Modification of the minimum lot width regulation, provided such modification
does not result in a lot width less than fifty (50) feet; 3. Walls or fences to exceed heights permitted by the zoning regulations; 4. Modifications to the sign area regulations, provided such modification does
