RE: ADMINISTRATIVE VARIANCE AV-90-3
Dear Mike ,
I am in receipt of your letter of incomplete submittal for the
above referenced variance request.
In response to the two items listed and per our phone conversation:
1. Calmat's property (APN 210-090-42) is in the process of being
sold. In meeting with them, they can see no benefit to them
to allow or be a co-applicant for the variance request if the
raised median were placed at this time, thus devaluing the
marketability of their sale. They would however consider
being a co-applicant with one condition:
a) Palomar and Co. Is site poses no traffic impact until the
time of it's development. The existing traffic on
Avenida Encinas currently is very light for a secondary
arterial. With these two observations in mind, it
appears that an acceptable condition would be to stripe
the median currently to allow left-turn opportunities
into the variance properties. To also currently bond for
the future construction of the raised median which will
be constructed at the time of development of Palomar &
Co. Is vacant parcel. The timing of the median in
conjunction with the development of the Palomar and Co.
property would not be tied to or preclude the occupancy of Pacific Point Business Center.
This would appear to be a reasonable solution to phase in
improvements as they are needed, to avoid the condemnation
process and solve an uncomfortable situation between the
landowners as well as the city staff. Mike, please check with Gary Wayne to review (He's familiar with the history of this).
2. ) Please find attached the t requested copies of the dimensioned
setback from the right of way for the existing buildings on
Palomar & Co. property and Calmat's property (APN 210-090-42).
