Brandow To : City of Carlsbad, Planning Department Attn: Mr. Michael Holzmiller, Vann Lynch, others concerned Dear Sir: I object to the granting of variance case file: AV 90-5 for the following reasons: 1. The garage addition and retaining wall was built knowingly on city right-of-way. 2. They were build sub-standard, (nat to Carlsbad building code specifications) and without properly approved city permits and blue prints. 3. The retaining wall in question is 56" in height, not 54", as is noted in your form letter dated June 12, 1990. The footing of this retaining wall was not dug to the proper size, with very little if any, steel retaining rods (rebar) used. The same can be noted for the footing on the garage addition also. I am in the process of working out a lot split with Fredericks Engineering and the City of Carlsbad. Easement would be granted to the back parcel by means of relocating my existing garage. A new garage would be built on the north side of front property. In order to meet all city conditions, my new garage can be no closer than 30 ft from my water meter box. This would push the new garage right up in front of my house completely blocking any view from three (3) of my room,(family room, dining room,and kitchen). Naturally, we are not happy with this, but in order to obtain permits and move forward with this project, we are willing to meet these conditions. My neighbor on the other hand, sees no reason why he can't build anywhere he chooses and without permits, etc. I personally object to this! I've lived in this area for over 30 years, having gone to school here and raised 4 children in Carlsbad. I think Carlsbad is one of the most beautiful cities in Southern California. / . I' e If people were allowed to build anythinq they wanted, where they wanted it, I wonder if Carlsbad would be as great a place to live and raise a family. I think not. The work accomplished by the city employees at the Building Department should be lauded for its quality and foresight. You are doing a great job, keep it up!! I would welcome the chance to meet with you in person to discuss this further. Thank you for the opportunity to express my view point on Case File AV 90-5. I hope you will reject this request.
