SUBJECT: ADMINISTRATIVE VARIANCE NO. 90-9 - Request to allow a 6 foot combined
retaining and yard wall within the front yard setback on property generally located
at the southeast comer of Hanison Street and Chinquapin Avenue, Carlsbad,
California.
Dear Mr. Grace:
The Planning Director has completed a review of your application for an Administrative Variance
at the southeast comer of Harrison Street and Chinquapin Avenue. After careful consideration of
the circumstances surrounding this request, the Planning Director has determined that the four
findings required for granting an Administrative Variance can be made and, therefore, APPROVES
this request based on the following findings and conditions.

There are exceptional or extraordinary circumstances or conditions applicable to the
property or to the intended use that do not apply generally to the other property or class
of use in the same vicinity and zone. In that privacy and security should be provided to the
future homeowners of Baywalk which will have rear yards facing Chinquapin.
The requested variance is necessary for the preservation and enjoyment of a substantial
property right possessed by other property in the same vicinity and zone but which is denied
to the property in question because a grade separation from the street would otherwise only
permit a 42" high screen and security wall to those property owners abutting Chinquapin
Avenue..
The granting of this variance will not be materially detrimental to the public welfare or
injurious to the property or improvements in the vicinity and zone in which the property
is located because the variation in wall placement and landscaping provided will enhance
the Chinquapin Street scope and will also allow for sufficient sight distance for safe
vehicular movement at the Chinquapin/H&on intersection.
The granting of this variance will not adversely affect the comprehensive General Plan
because screen and security fencing is a common feature within residentially zoned
neighborhoods..
