VA&&E 9l-087 Request to maintain an existing combination retaining/screening wall that ranges in height from 6 to 10 feet in the required side and rear yard setback in a single-family residential zone, where 6 feet is the maximum wall height permitted. ~,~,,. &u&d.k ,. I/ . . . i - .. Dear Mr. Escano: The Planning Director has completed a review of your application for an Administrative Variance at the southwest corner of Las Flores Drive and Tuttle Street. After careful consideration of the circumstances surrounding this request, the Planning Director has determined that the four findings required for granting an Administrative Variance can be made, and, therefore APPROVES this request based on the following findings and conditions. Findinas: 1. There are exceptional or extraordinary circumstances applicable to the property that do not apply generally to the other property in the same vicinity and zone. The lot slopes down to the southwest and the placement of retaining walls ranging in height from 1 to 4 feet were required along the southern and western property lines for adequate lot drainage. The subject property is located adjacent to parcels that have agricultural uses, horses and accessory uses located on the southern and western property lines. These types of land uses are not abundant nor commonly found in the immediate neighborhood surrounding the property. 2. The requested variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone but which is denied to the property in question. To provide adequate buffering from pesticide spraying, odors and flies from the horses and the accessory uses on the adjacent southern and western properties lines, a solid screen wall/fence on top of the required retaining walls is necessary for the reasonable use of the rear and side yards of the subject property. 2075 Las Palmas Drive - Carlsbad, California 92009-4859 - (619) 438-1 161 Ray Escano August 1, 1991 Pacle 2 3. The granting of this variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and zone in which the property is located. The walls are not visible from Buena Vista Way and only partially visible from Jefferson Street. The walls/fences will benefit the surrounding properties by providing rear yard privacy. The placement of vertical reveals every six feet along the south facing exterior of the wall will be required to visually break up the monotony of the long linear wall. The required use of a textured and painted stucco material will help to soften the visual impacts of the wall. 4. The granting of this variance will not adversely affect the comprehensive General Plan. Residential, agricultural land uses, and retaining and screen walls are permitted in the R-1 Zone. The screen wall will make the residential and agricultural, land uses more compatible by providing adequate buffering and screening. Conditions: 1. Prior to occupancy of any units, textured stucco facing and vertical reveals every six to eight linear feet along the exterior of the south facing masonry wall shall be required to enhance and soften the appearance of the wall and to provide visually interest. 2. Prior to occupancy of any units, the wood fence on top of the retaining wall located along the western property line shall not exceed a height of 5 feet. You have the right to appeal this decision to the Planning Commission within ten days of receipt of this letter.
