JUSTIFICATION FOR VARIANCE
By law a Variance may be approved drily if 2erta.i.n facts are found to exist. Please read these
requirements carefully and explain how the proposed project meets each of these facts. Use
additional sheets if necessary.
1. Explain why there are exceptional or extraordinary circumstances or conditions applicable to the property or to the intended use that do not apply generally to the other property Or
class of use in the same vicinity and zone:
The original structure was built in the early 1950's. The non-conforming
setback existed prior to the applicants purchase of the property and the
setback encroachment was not disclosed during the sale of the property.
2. Explain why such variance is necessary for the preservation and enjoyment of a substantial
property right possessed by other property in the same vicinity and zone but which is denied
to the property ii question:
Setbacks (along Carlsbad Blvd. ) of adjacent parcels have been surveyed

3. Explain why the granting of such variance will not be materially detrimental to the public

The existing non-conformity is a minor encroachment that has existed
for 40 years and adjacent properties with similar conditions, with
structures of equal to or greater magnitude, of the proposed development
