The Planning Director has determined that the four findings required for granting an Administrative Variance can be made and, therefore, APPROVES this request based on the following findings and conditions. 1. Exceptional conditions apply to the subject property that do not apply to the other properties in the same vicinity because the rapid erosion of the site hm wave action results in a der buildable lot area than that of neighboring lots. 2. The Administrative Variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property but which is denied to the property in question because the buildable area of the lot is der than stmounding lots due to erosion, and dghbodq developments are built with reduced sideyards. 3. The granting of an Administrative Variance will not be materially detrimental to the public welfm or injurious to the property or improvements in the vicinity and zone because it will allow the subject development to COIlform with neighboring develapments. 4. The granting of an Administrative Variance will not adversely effect the General Planbecausethepraposeddevelopmentisfaronedwelling~~consistentwi~the UseSallowedbytheGeneralPlan. 5. Approval is granted for AV 91-13, as shown on Exhibits 'lA"-llG1l, dated October 7, 1992, incorporated .by reference and on file in the Planning Department. Development shall occur substantially as shown unless otherwise noted in these conditions. 2. All of the conditions of Planning Commission Resolution No's. 3437 and 3438 are hereby incorporated by reference. This decision may be appealed by you or any member of the public to the Planning Commission within ten days of receipt of this letter. Appeals must be submitted in writing to the Planning Commission at 2075 Las Palmas Drive in Carlsbad, along with a payment of $110.00. The filing of such appeal within such time limit shall stay the effective date of the order of the Planning Director until such time as a final decision on the appeal is reached.
