Setback requirements for the rear yard should be waived since no new construction is proposed. The variance approval will not affect the comprehensive plan or be detrimental to the public welfare. Please read these requirements carefully and explain how the proposed project meets each of these facts. Use additional sheets if necessary. 1. Explain why there are exceptional or extraordinary circumstances or conditions applicable to the property or to the intended use that do not apply generally to the other property or , class of UM in the same vicinity and zone: This project has an existing structure that was previously approved by the City of Carlsbad. The setback requirements for the rear yard should be waived since no new construction is proposed with this tentative parcel map. 2. Explain why such variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone but which is denied to the property in question: There are many existing duplexes in the immediate neighborhood that have been converted into condominiums. To deny this project because Of a setback on an existing structure would deprive the owners the same use enjoyed by others. 3.
